| Project | Developer | Jurisdiction | Action | Capital | Sources |
| --- | --- | --- | --- | --- | --- |
| Project Marvel residents' rezoning lawsuit (Rock Mountain Road, Bessemer)litigation Dismissed on a Monday afternoon; reported 25 June 2026 | TPA Group / Logistics Land Investments | Jefferson County Circuit Court | A Jefferson County senior circuit judge dismissed the lawsuit brought by residents David Havron, Ronnie Buchanan and Becky Morgan against the City of Bessemer over the rezoning for Project Marvel; the residents and the city requested the dismissal together. The suit, filed in April 2025, alleged Bessemer failed to give proper public notice when rezoning the initial 700 acres. AL.com reported it was unclear why the case was dismissed; the council later rezoned another 900 acres for the project's expansion. | $14.0B | |
| Lowndes County data center moratoriummoratorium Enacted August 2026 | n.a. | Lowndes County | Lowndes County, Alabama, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated August 2026. County commissioners unanimously approved 60-day moratorium on data center permits; response to proposed 1,050-acre "Project Red Clay" hyperscale data center; county lacks formal zoning authority, legal standing uncertain. The measure runs to 25 October 2026. | $1.5B | |
| Edged Energy Prichard data center (Telegraph Road) building permit disputeapproved after delay Permit challenge raised 20 August 2026; litigation threat referred to council attorney, reported 11 September 2026; site plan approved by the Planning Commission 29 September 2026; single outlet for the approval | Edged Energy | Prichard City Council | At its 20 August meeting the Prichard City Council moved toward invalidating the building permit for Edged's proposed $93 million data center and refunding $224,000 in fees, with the council attorney saying the permit was issued without required Planning Commission site plan review. An attorney for Edged Energy then sent a letter threatening a lawsuit if the city tries to block the permit, and the council voted unanimously to refer the matter to its attorney. The council attorney said the city has no real way to stop this project but that the Planning Commission review step must be followed, while Mayor Carletta Davis said the project will move forward. On Tuesday 29 September 2026 the Prichard Planning Commission approved the site plan, completing the review step the council attorney said had been skipped before the 30 July 2026 building permit. Edged's attorney said the building permit predates the city's 4 August 2026 six-month moratorium, so the moratorium does not apply; the site is about eight acres, construction is expected to take 18 months and groundbreaking could come at any time. | $93M | |
| Anniston data center moratoriummoratorium Adopted 18 August 2026 | n.a. | City of Anniston | The city council adopted a resolution on 18 August 2026 establishing a 12-month moratorium on data centers within the city's regulatory jurisdiction, subject to extension or shortening by council. The Planning Commission must study and recommend standards for siting, electrical demand, water consumption, stormwater, noise and neighborhood compatibility within six months. The resolution cites the growth of US data center electricity consumption from 58 TWh in 2014 to 176 TWh in 2023. | n.a. | |
| Baldwin County 180-day moratorium on rezonings, data centers and renewable energy projectsmoratorium Passed unanimously, reported 6 October 2026; 180 days; single outlet (fetched) | n.a. | Baldwin County Commission | The Baldwin County Commission unanimously passed a resolution enacting a 180-day moratorium on zoning change requests, renewable energy projects and the development of data centers throughout the county; Commissioner Skip Gruber was absent. The commission had earlier asked the Alabama Attorney General's Office whether it could impose such a pause. | n.a. | |
| Chelsea one-year moratorium on data center permitsmoratorium Adopted on a Tuesday evening; reported 21 July 2026; one year | n.a. | Chelsea City Council | The Chelsea City Council voted to implement a one-year moratorium on permits for new data centers and residential rental units while the city evaluates its zoning regulations. Mayor Cody Sumners said the city will use the year to review its zoning ordinances and make adjustments. | n.a. | |

The council will study zoning, infrastructure capacity, and community character before permanent decisions. WBRC reported the council vote was unanimous and the temporary moratorium runs 12 months. | n.a. | |
| Decatur data center special exception ordinanceother Approved 17 August 2026 | n.a. | Decatur City Council | The Decatur City Council approved an ordinance requiring any data center developer to present a project overview to the council in public, after which the council recommends to the Board of Zoning Adjustment whether to grant a special exception permit through a public process. Projects must also address water and power consumption and on-site generation and complete studies on fire protection, noise, hazardous materials and waste. The city said no developers were seeking to build and that limited land makes hyperscale campuses unlikely. | n.a. | |
| Fairfield data center moratorium (Patmos project exempt)moratorium Adopted 20 July 2026 | Patmos | Fairfield City Council | The Fairfield City Council voted to place a moratorium on future data center projects after residents and council members pressed for details, and the mayor then named Missouri-based Patmos as the company proposing a colocation data center. The Patmos project was left in place because it was under consideration before the moratorium passed. Patmos has proposed converting the former Walmart Supercenter into a data center and technology campus, and the mayor said design plans would still need City Council approval. | n.a. | |
| Foley six-month data center and cryptocurrency mining moratoriummoratorium Final reading approved 8 September 2026; six months | n.a. | City of Foley | The Foley City Council approved on final reading an ordinance establishing a six-month moratorium on accepting, processing, or approving applications for data centers, cryptocurrency mining facilities, and server farms. The vote was held Tuesday, 8 September 2026. Mayor Ralph Hellmich said the city-owned utility already has some protections on water, noise, and electricity use. | n.a. | |

The city said there were no pending applications. | n.a. | |
| Leeds data center moratoriummoratorium Reported 8 June 2026 | n.a. | City of Leeds | The Leeds City Council passed a moratorium on data centers, according to WBRC. The Cullman Tribune later described Leeds' measure as a one-year moratorium. | n.a. | |
| Morgan County 12-month data center moratorium (Union Road bitcoin mining site near Somerville)moratorium Approved on a Tuesday; reported 23 June 2026; 12 months, described by county as unenforceable in August 2026 | Sovereign Gazelle (named VoltCore by WAFF) | Morgan County Commission | Morgan County commissioners adopted a resolution imposing a 12-month moratorium on data centers in unincorporated Morgan County after more than 450 residents petitioned against a proposed bitcoin mining data center on Union Road near Somerville. In August the county attorney said the moratorium cannot be enforced because the county has no zoning laws, and the commission chairman said it was meant to signal support for the neighborhood. The Decatur Daily reported the company was exploring an underground route for power lines to serve the 50-megawatt facility. | n.a. | |
| Nebius Oxmoor Valley data centerlitigation Ruling 10 July 2026; merits hearing 8 March 2027 | Nebius | Jefferson County Circuit Court / City of Birmingham | Neighbors sued Nebius, Hoar Construction and the City of Birmingham, alleging the city issued permits for a hyperscale data center on land not zoned for that use. On 10 July 2026 Circuit Judge Javan Patton Crayton ruled the case can proceed without first going to the Zoning Board of Adjustment. On 14 August 2026 the judge granted the plaintiffs' request to skip the preliminary injunction and go to the merits, with the next hearing set for 8 March 2027. Construction continues, with completion projected for 2028. Additional suits filed: the Greater Birmingham Humane Society sued the City of Birmingham, Alabama ADC Holdings LLC and 201 Milan Birmingham LLC in Jefferson County Circuit Court on 10 July 2026, seeking review of permits and approvals for the project next to its planned animal campus. On 5 September 2026 Regions Bank shareholder James Anderson filed a derivative suit alleging Nebius affiliates defrauded the bank of $66.3 million in the 30 September 2025 sale of 201 Milan Parkway. Former school board member Terri Michal sued (filed on a Thursday afternoon, reported 11 September 2026) Birmingham's Industrial Development Board, its chairman and Nebius, asking a judge to cancel the $3.2 billion in 30-year tax abatements approved 29 May 2026 under the Open Meetings Act; AL.com described the project as $36 billion and 300 MW on about 75 acres. On Thursday 17 September 2026 Judge Javan Patton Crayton consolidated three existing suits, including the residents' suit and the Humane Society's; the 8 March 2027 hearing stands. In filings between 16 and 22 September 2026 the plaintiffs gave notice of subpoenas to 10 parties, including U.S. Steel, Alabama Power, Regions Bank and a real estate firm founded by the mayor's wife; the city objected on 1 October 2026 and Regions Bank objected on 30 September 2026. The judge set a hearing on the objections for Monday 5 October 2026. AL.com reports that three suits have been consolidated into this case. | n.a. | |

It followed community concern about whether future development at Commerce Park might include a data center. | n.a. | |
| Tarrant 12-month data center moratoriummoratorium Reported 8 September 2026; 12 months | n.a. | City of Tarrant | Tarrant city officials approved a 12-month moratorium on data centers. Mayor Tracie Threadford said the decision was made out of caution. She noted several buildings for sale in the city could fit a smaller data center project. | n.a. | |
| Westover data center moratoriummoratorium Adopted 18 August 2026 | Swift Willow Property | City of Westover, Shelby County | The city council voted unanimously on 18 August 2026 to adopt a six-month moratorium on data centers while it studies the industry and considers zoning changes. The pause follows a proposal by Swift Willow Property for a campus of nearly 450 acres along Highway 280 and Cheshire Drive, with at least two buildings on 124 acres. The city held a town hall on 20 August 2026 with the developer, Shelby County Water Services and Alabama Power. | n.a. | |

Policy context

## What governs a data center in Alabama

Alabama (large-load data center contract law effective 1 October 2026)state

Applies to data centers needing 150 MW or more at peak in Alabama Power's service territory; effective 1 October 2026. Conditions on cost recovery, not a moratorium. Act number not given in the fetched source

A state law taking effect on 1 October 2026 sets the standard the Alabama Public Service Commission must use to approve large-load contracts between Alabama Power and data centers of 150 MW or more: the contract must be expected to pay the extra costs of serving the customer, including generation, transmission, fuel and taxes, and to benefit other customers. APSC President Cynthia Almond said the law largely codifies protections the commission already applied. Public versions of the contracts are heavily redacted, with pricing, contract length and minimum billing terms blacked out, and there is no public hearing or vote; the APSC and the Attorney General's Office receive unredacted copies. In a proceeding opened in July 2026 the commission extended its review window for data center contracts from 10 to 45 days and has proposed 60 days going forward. Three large-load contracts have been filed since July: ADC Holdings, LLC, tied to the Nebius Oxmoor Valley project, was deemed approved, while Wooster, LLC and APLD BHM-01 LLC, tied to Applied Digital in Tuscaloosa County, remain under review. On Tuesday 6 October 2026 the Alabama PSC unanimously adopted a new process for contracts between Alabama Power and data centers: Alabama Power must publish a public summary listing the facility location, the company and the maximum electricity the data center will consume, and file non-public versions with contract terms and its cost and capacity analysis with the PSC and the Attorney General's Office. Under an amendment by President Cynthia Almond, the commission must vote on each agreement in a public meeting within 90 days of the filing or it takes effect automatically. Previously, staff-recommended contracts were approved unless commissioners intervened within 10 days. The process applies only to Alabama Power.

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.
