The complaint alleges violations of Georgia's Open Meetings Act and Open Records Act, including a July meeting rescheduled without required notice, an agenda listing only 'Project Gateway', discussion of the tax abatement in closed session, and the sale of roughly 1,440 acres to Octans without a public vote on terms. The residents allege the county was required to hold two public hearings before making that change, one before the planning board and one before the county commission, under state law and the county's own rules, and that it held neither. The complaint also cites a non-disclosure agreement signed by County Manager Tim Callanan with OpenAI that it says forbade him from sharing information about Project Camellia with residents. The suit asks the court to throw out the ordinance and bar the county from using it unless the required zoning procedures are followed. The campus is reported at up to 3.2 GW of electricity demand, which local reporting compares to roughly three cities the size of Atlanta. No court ruling has issued and the project is not stopped; this record captures a filed challenge to the zoning instrument. The capital figure is left blank because the $20 billion attached to the project in press coverage is not disclosed in the complaint. | n.a.

Commissioner Doreen Williams recused herself on all four items. A 24 September 2026 zoning hearing had ended without a decision. | n.a.

Under separate consent orders the Georgia EPD assessed penalties of $31,000 against ServerFarm and $11,500 against VoltaGrid, and both now hold construction permits under a combined permit that limits generator operation. The Georgia PSC could also act but its process is at an early stage. | n.a.
| Shadowbox Studios data center (International Park Drive)litigation Lawsuit filed on a Friday, reported 10 August 2026; appeal denied 9 September 2026 | Shadowbox Studios | DeKalb County Zoning Board of Appeals and DeKalb County Superior Court | The DeKalb County Zoning Board of Appeals voted to affirm the county's refusal to process Shadowbox Studios' application to convert its land development permit from a film studio to a data center, which the county said was barred by its data center moratorium. Board members said the dispute belongs in court. Shadowbox filed a civil lawsuit against DeKalb County in August 2026, reported as seeking $30 million, arguing the planning department confirmed in writing three times that a data center was allowed and that the repeatedly extended moratorium is defective. The county moratorium currently runs through the end of March 2027. | n.a. | |

Almost 1,700 residents signed a petition against it, and the Bartow County Planning Commission voted 6-1 on 28 April 2025 to recommend denial. The developer's attorney formally withdrew the rezoning application on 13 May 2025, the day before the county commissioner's meeting. | n.a.
| Statesboro data center rezoning (6539 Burkhalter Road)litigation Rezoning 18 August 2026; challenge filed 17 September 2026; repeal petition drive reported 2 October 2026 | 4 AM Development LLC | Bulloch County Superior Court / City of Statesboro | City Council approved a 3-2 rezoning from R-4 to O for 4 AM Development LLC on 18 August 2026. On 17 September 2026 Coastal Communities United and 11 citizens filed a petition for review and request for declaratory judgment in Bulloch County Superior Court against the City of Statesboro and 4 AM Development LLC, the parcel's owner. The petition alleges the city disregarded its own procedures and state law, that the decision was arbitrary and capricious, and that it violated the petitioners' substantive and procedural due process rights under the Georgia Constitution; it also argues the 99 MW project sits one megawatt under the city's hyperscale definition. The Statesboro Herald reported on 2 October 2026 that an informal citizens group, Protect Statesboro, has started a petition drive for a referendum to repeal the city's Technological Facilities and Data Centers Ordinance (adopted 3-1 on 2 June 2026), separate from the court challenge. The developers have submitted a preliminary sound study and water use plan toward the special use permit, which requires another council vote. The planned building is two stories and about 230,000 square feet on roughly 27 acres. | n.a. | |

Guido filed notices of appeal on 13 April 2026, and the appeals were docketed at the Georgia Court of Appeals on 16 June 2026. | n.a.

By year 20 annual payments reach $77 million, split $29 million to the county, $43.5 million to the school district and $4.6 million to the development authority. The structure relies on ownership by the Monroe County Development Authority, which would lease the facility back to Google, exempting it from standard private property taxes and replacing those levies with contractual payments distributed through the lease. The project still requires further clearances, including confirmation of the site location within Monroe County and adherence to job-creation targets. Policy context

## What governs a data center in Georgia

Georgia (statewide)state

Statewide HB 1192 was vetoed and SB 476 failed; HB 1059 would forbid local permitting until December 2028. C.4 floors: 250 MW (Calhoun); $17B (Project Sail); 4 named; 29-31 tracked actions.

Dimetrics tracks 29 to 31 Georgia actions including a Fayetteville outright ban in March 2026, directly relevant to QTS's Fayetteville position, plus restrictive zoning in Bartow, Forsyth, Jones, Lumpkin and Atlanta. The PSC meanwhile approved the 2025 IRP contemplating ~8,500 MW of load growth and, on December 19, 2025, 9,885 MW of new energy resources by a 5-0 vote.

Georgia (PSC large-load rule for Georgia Power)state

Applies to new Georgia Power customers above 100 MW; approved unanimously 23 January 2025; contracts must be filed with the PSC for review. Conditions on service, not a moratorium

The Georgia Public Service Commission voted unanimously on Thursday 23 January 2025 to approve a Georgia Power rule letting the utility bill new customers using more than 100 MW, chiefly data centers, under terms beyond standard service to address their risks. Beyond site-specific costs, such customers pay for upstream generation, transmission and distribution costs incurred as their projects progress; contract terms may run 15 years instead of 5, with minimum billing requirements; and every new Georgia Power contract in the 100 MW category must be submitted to the PSC for review. The rule derives from the interim IRP decision of April 2024 (Docket 55378).

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.
