## Blocked, delayed or restricted in Kentucky

Every project in Kentucky on the atlas's capital-at-risk record: the action taken, who took it, and the announced capital affected. Restarts and reversals are recorded with the same weight as blocks.

| Project | Developer | Jurisdiction | Action | Capital | Sources |
| --- | --- | --- | --- | --- | --- |
| Project Lincoln: OC Data Centermoratorium July 2, 2025 | Western Hospitality Partners | Oldham County | Western Hospitality Partners proposed 'Project Lincoln: OC Data Center,' a $6B, 600MW facility initially planned for 267 acres at 3557 North Highway 53. | $6.0B | |
| Project Lincoln: Oldham County data centerwithdrawn Moratorium passed 4-2 on 1 July 2025 (150 days); project withdrawn 3 July 2025 | Western Hospitality Partners | Oldham County Fiscal Court | Western Hospitality Partners announced in March 2025 a 600-megawatt hyperscale data center on agricultural land in Oldham County, then in June 2025 dropped that site and applied for a smaller 100-megawatt facility at the site of a drive-in theater. On Tuesday 1 July 2025 the Oldham County Fiscal Court passed a 150-day moratorium on data center applications by 4-2, striking language that would have exempted the pending application. On Thursday 3 July 2025 the company said it was withdrawing the application and that the project, described by WLKY as a $6 billion data center, would not proceed. WLKY reported on 24 August 2026 that the county's moratorium on data centers remained in effect while proposed data center regulations went back to the planning commission. | $6.0B | |
| TenKey LandCo Franklin data centerlitigation County ordinance December 2025; developer suit filed 20 January 2026; single outlet | TenKey LandCo | Simpson County Fiscal Court / City of Franklin | Franklin's city council and planning commission voted unanimously in 2025 to reject a zoning change sought by the developer, and in December 2025 the Simpson County Fiscal Court passed an ordinance requiring heavy industrial zoning and a conditional use permit for data centers. TenKey LandCo sued the fiscal court in Simpson Circuit Court on 20 January 2026 seeking to strike down the ordinance. The Franklin planning commission also tabled a vote on TenKey's preliminary development plan in January 2026. | $5.0B | |
| Allen County data center moratoriummoratorium Enacted June 2026 | n.a. | Allen County | Allen County, Kentucky, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated June 2026. 2-year moratorium (Ord. 26-03). Proactive, Judge-Executive observed 'headaches' in nearby Simpson County with hyperscale proposal. The measure runs to 10 June 2028. | n.a. | |
| Bell County (Kentucky) two-year data center construction moratorium (Murray Industries site)moratorium Approved on second reading 2 July 2026; two years; single outlet | Murray Industries | Bell County Fiscal Court | Bell County officials voted on Thursday 2 July 2026 to approve a two-year moratorium on data center construction on second reading, without opposition, with Judge Executive Albey Brock presiding. The vote, moved up from 14 July, halts a Murray Industries project that had already begun clearing land. WYMT said it was unclear whether the moratorium would be challenged in court. | n.a. | |
| Burgin hyperscale campus annexationdelayed Prior annexation void; 8 September 2026 meeting lost quorum before the annexation vote; planning and zoning rejoin agreement passed first reading on the mayor's tie-break; no new annexation vote scheduled as of 17 September 2026 | Panattoni Data Centers | City of Burgin | Burgin's earlier attempt to annex more than 1,000 acres for a Panattoni Data Centers hyperscale campus was declared null and void. The city restarted the process in September 2026 with adjusted boundary lines, and the city council was scheduled to vote at a special meeting on 8 September 2026 to begin drafting a new annexation ordinance for the revised land. Residents opposing the project called for basic protections and third-party expertise during the drafting. At the 8 September 2026 special meeting, the council passed the first reading of an ordinance to rejoin the joint planning and zoning commission on Mayor Joseph Monroe's tie-breaking vote. Council member Melinda Wofford then left the meeting, leaving the council without a quorum, so no vote was taken on the annexation measure. The zoning ordinance still needs a second reading, state review and a final council vote; the mayor said rejoining makes development harder but does not end the project. The Harrodsburg Herald reported on 17 September 2026 that the council had approved the data center annexation of 10 properties at a July special meeting but a later special meeting for second reading was canceled, and that the 8 September vote was only to have the city attorney draft a new annexation ordinance. The interlocal agreement to rejoin the Harrodsburg-Burgin-Mercer County Joint Planning and Zoning Commission still needs second readings by all three bodies and Kentucky Department of Local Government approval | n.a. | |
| Butler County data center moratoriummoratorium Enacted June 2026 | n.a. | Butler County | Butler County, Kentucky, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated June 2026. Fiscal court approves one-year moratorium; no DCs currently proposed. The measure runs to 26 June 2027. | n.a. | |
| Cave City data center moratorium lawsuit (2001 Doyle Avenue)litigation Moratorium final reading 20 May 2026; lawsuit filed 8 June 2026; reported 25 July 2026 | Kentucky Industrial Alliance, LLC | City of Cave City, Joint City-County Planning Commission and Cave City Council | Kentucky Industrial Alliance filed a lawsuit against Cave City, its city council and the joint planning commission, arguing the city's data center moratorium violated KRS 100 and should be declared invalid. The council rejected a data center zoning amendment and passed the moratorium on 11 May 2026, with final reading approved 4-1 on 20 May 2026, after packed meetings over impacts near Mammoth Cave National Park. The company claims vested rights because it filed a development plan on 11 May 2026 and says the moratorium was rushed and passed in bad faith. The Lexington Herald-Leader reported the developer outlined a 600-acre, 1.2 GW campus and filed a second lawsuit challenging the 2024 ordinance that annexed the property into city limits, seeking to place the land outside the moratorium. | n.a. | |
| EastPark projectother Jul 2026 | TeraWulf | Greenup & Boyd Counties, KY | Exempt from six-month county moratoriums | n.a. | |
| Georgetown data center moratoriummoratorium Enacted July 2026 | n.a. | Georgetown | Georgetown, Kentucky, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated July 2026. City council backs moratorium on data centers through end of year; directs Georgetown-Scott County Planning Commission to recommend zoning regulations. The measure runs to 31 December 2026. The Georgetown City Council voted unanimously on Tuesday 29 September 2026 to ask legal counsel to prepare an ordinance banning data centers and defining hyperscale data centers; the ban would also need Planning and Zoning Commission approval. Scott County extended its own moratorium to March 2027. | n.a. | |
| Jefferson County data center moratoriummoratorium Aug 13 2026 | n.a. | Louisville Metro / Jefferson County | Metro Council voted 24-1 on 13 August 2026 to adopt a six-month moratorium barring city planners from approving new data center proposals, running until the council adopts comprehensive zoning rules. An amendment extended the pause to the rezoning of an existing building for data center use. A one-year version failed. Local proposals cited in the debate were a Dermody Properties data center in a 350,000 sq ft warehouse on Kramers Lane and a hyperscale facility already under construction on Camp Ground Road. | n.a. | |
| Lexington (Fayette County) data center moratoriummoratorium Enacted June 2026; expires 31 October 2026; extension to October 2027 advanced 6 October 2026, readings pending | n.a. | Lexington (Fayette County) | Lexington (Fayette County), Kentucky, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated June 2026. Moratorium on permits, development plans, and zone changes, unanimous. Expires Oct 31; Planning Division drafting Zoning Ordinance Text Amendment proposals. The measure runs to 31 October 2026. On Tuesday 6 October 2026, after a nearly four-hour hearing, the Urban County Council voted unanimously to move forward an extension of the moratorium to October 2027 and to send the data center zoning text amendments back to the Planning Commission; the extension still needs a first reading and a final vote later in October 2026. The moratorium has put on hold DartPoints' data center on the Lexmark property. | n.a. | |
| Logan County data center moratoriummoratorium Enacted July 2026 | n.a. | Logan County | Logan County, Kentucky, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated July 2026. 12-month pause in unincorporated areas, adopted specifically to study local water supply capacity against high-consumption users. The measure runs to 30 September 2028. | n.a. | |
| Louisville-Jefferson County Metro six-month moratorium on new data centersmoratorium Adopted August 2026 | n.a. | Louisville-Jefferson County Metro | Metro Council voted 24-1 on Aug. 13, 2026 to bar planners from approving new data center proposals for six months or until comprehensive zoning rules are adopted; amended on the floor to also cover conversions of existing buildings. | n.a. | |
| Lyon County data center moratoriummoratorium Enacted August 2026 | n.a. | Lyon County | Lyon County, Kentucky, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated August 2026. Data center moratorium ordinance passed unanimously by the fiscal court, which will form a committee on environmental impact and utility use; reported as delaying inquiries for up to two years, modelled on Allen County's 2-year ordinance. Magistrates and Judge-Executive Jaime Green-Smith said the Lake Barkley area may be unsuitable for a data center. No outlet gave the vote date or an end date, so none is recorded here. The measure has a stated duration whose end date is not recorded. | n.a. | |
| Meade County data center rezoning (Joe Prather Highway)denied Denied 14 October 2025 | Not identified in reporting | Meade County | The Meade County Planning and Zoning Commission voted unanimously in October 2025 against rezoning a roughly 138-acre site on Joe Prather Highway from agricultural to light industrial for an AI data center. The Fiscal Court then unanimously upheld that recommendation. More than 150 speakers registered, and a petition opposing the project gathered over 2,500 signatures. | n.a. | |
| Mercer County one-year data center application moratoriummoratorium Passed Tuesday 11 August 2026; one year; data center zoning ordinance rejected 28 September 2026 | Panattoni (Project Bluegrass, proposed via Burgin annexation) | Mercer County Fiscal Court | The Mercer County Fiscal Court unanimously passed an ordinance for a one-year moratorium on applications to build new data centers in unincorporated areas. The moratorium would not apply if the city of Burgin annexes land for Panattoni's proposed Project Bluegrass hyperscale data center; Burgin has no planning and zoning rules. The same evening Burgin's council did not take up the annexation proposal while residents voiced opposition. The Fiscal Court first approved a motion for the moratorium on 28 July 2026, with a second reading required before formal adoption. On Monday 28 September 2026 the Fiscal Court unanimously voted down a proposed zoning ordinance that would have created a new district for large-scale data centers and set siting and operating rules. Shaker Village of Pleasant Hill said the ordinance would have allowed a data center within 2,000 feet of the landmark's border. Panattoni continues to pursue a 950-acre data center despite the moratorium. | n.a. | |
| Nicholasville six-month data center moratoriummoratorium Adopted August 2026 | n.a. | Nicholasville | The city commission passed a six-month moratorium on data centers on Aug. 10, 2026, citing utility cost, property tax and water-consumption concerns in the surrounding farming community. | n.a. | |

Rubix, which has a $55 million agreement to buy the former AK Steel Ashland Works from Cleveland-Cliffs for a 2 GW facility, needs Russell to lift its moratorium before closing. Cleveland-Cliffs moved the closing deadline from 31 August to 25 September and then to 15 October 2026 to give Russell time to adopt zoning rules; city officials said zoning will come first. | n.a. | |
| Scott County data center moratoriummoratorium Enacted March 2026; extended 24 September 2026 to March 2027 | n.a. | Scott County | Scott County, Kentucky, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated March 2026. The measure runs to 31 December 2026. | n.a. | |
| Winchester one-year data center moratoriummoratorium Approved 1 September 2026 | n.a. | Winchester | The Winchester Board of Commissioners voted unanimously on 1 September 2026 for a one-year moratorium on data center development within city limits, citing the absence of specific zoning rules. The planning director told commissioners that communities from Lexington to London had moved to slow or halt new data center proposals. | n.a. | |
| Woodford County permanent data center banmoratorium Ordinance passed unanimously Tuesday 8 September 2026; reported 10 September 2026 | n.a. (county-wide land use action) | Woodford County | The Woodford County Fiscal Court passed an ordinance unanimously on Tuesday 8 September 2026, reported 10 September 2026, permanently banning construction of landfills, data centers and large battery storage systems within the county. It is the first Kentucky county to adopt a permanent ban rather than a temporary moratorium. Judge-Executive James Kay said no developer had pitched a specific data center proposal in the county but that developers were looking everywhere, and cited the divisive debate over the proposed hyperscale campus in Burgin, Mercer County, as the reason for choosing a permanent ban. The measure follows a years-long effort to preserve farmland, including Thoroughbred horse farms. | n.a. | |

Policy context

## What governs a data center in Kentucky

Kentucky (Executive order on data centers)state

Applies to prospective data center projects statewide; local approval decisions remain with communities

Governor Andy Beshear issued an executive order on 6 August 2026 requiring developers to show before approval that projects will not raise utility rates, barring utilities from raising rates to recover data center costs, and directing the Energy and Environment Cabinet to deny permits that would harm air or water. On 27 August 2026 he said he would support repealing the state's data center sales and use tax incentives, which the legislature extended to all 120 counties in 2025.

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.

Open the scarcity tracker →

Have a specific address? Site Intelligence reads all seven references against one location, county, utility and grid operator included, and cites every finding.
