Capital at risk

## Blocked, delayed or restricted in Missouri

Every project in Missouri on the atlas's capital-at-risk record: the action taken, who took it, and the announced capital affected. Restarts and reversals are recorded with the same weight as blocks.

| Project | Developer | Jurisdiction | Action | Capital | Sources |
| --- | --- | --- | --- | --- | --- |
| Beltline Energy data center (Highway O site)approved after delay City rezoning request tabled 25 February 2026; county rezoning approved 15 September 2026 | Beltline Energy | City of Pacific Planning and Zoning Commission | Beltline Energy pulled its rezoning request for a proposed $16 billion data center from the agenda of a special Pacific Planning and Zoning Commission meeting on 25 February 2026, minutes into the meeting, citing an inability to finalize a funding agreement. Residents who had filled a high school auditorium to speak against the project were not able to address the commission. The city later adopted a 12-month data center moratorium (separate row). First Alert 4 describes the city request as tabled. The Franklin County Commission approved rezoning for the same Highway O site, the Meramec Valley Technology Park, on 15 September 2026. | $16.0B | |
| Nebius Independencelitigation February 10, 2026 | Nebius | Independence | Independence City Council approved $6.26 billion in tax breaks over 20 years for Nebius on March 2, 2026, including a 98% real property tax abatement, 90% personal property tax abatement | $6.6B | |
| CRG Festus campus litigationlitigation Suit filed 8 April 2026 | CRG (Clayco) | City of Festus, Jefferson County | Wake Up Jeffco LLC, Sherman Doyle, Vernon Valish, Sharon Valish and Rozilyn Daniels filed suit on 8 April 2026 in St. Louis County Circuit Court against the City of Festus and CRG Acquisition LLC, seeking to stop the project by invalidating the city's rezoning decisions and its development agreement. The suit followed the council's 6-2 approval of the development agreement on 30 March 2026. Motions to dismiss had been filed and answered as of mid-June 2026, and as of 12 June 2026 no construction plans or permit requests had been submitted. The council separately voted 5-2 on 24 August 2026 to annex three additional parcels for the project. On 24 August 2026 the Festus City Council voted 5-2 to annex three more parcels totaling 6.55 acres along Hwy. 67 for the CRG data center project, which the Leader describes as a hyperscale data center on 361 acres that CRG, the data center development arm of Clayco, estimates will cost US$6 billion. The council approved a development agreement with CRG Acquisition on 30 March 2026, and CRG's president hopes construction starts in November 2026. The St. Louis Post-Dispatch reports data center opponents were in Jefferson County court over whether a recall of four Festus officials should go before voters. | $6.0B | |
| TerraWatt Midtown (Armory) data centerlitigation Developer and opponent suits reported 29 September 2026; developer suit filed the week of 21 September 2026; single outlet | TerraWatt | City of St. Louis | St. Louis approved the Midtown data center with a community benefit agreement that lets the city fine the developer for tax revenue and job shortfalls and revoke permits for uncorrected noncompliance. TerraWatt's chief executive then sued the city, arguing the requirements exceed its powers and would make construction impossible, and several opponents separately sued the city to stop the development. | $3.0B | |
| Former Emerson campus technology hub and data centerapproved after delay Rejected May 2026 on a 3-3 vote; revived legislation introduced 10 September 2026; approved 4-3 on 22 September 2026; referendum petition launched 23 September 2026, signature drive continuing as of 2 October 2026 | Next Revolution Technologies | City of Ferguson | The Ferguson City Council rejected the tax incentive package in May 2026 on a 3-3 vote with one abstention. On 10 September 2026 council members Nick Kasoff and LaMika Covington introduced legislation reviving it, with a final vote expected later in September 2026. The revived plan keeps a 75 percent abatement for the first ten years and adds a $7.5 million commitment to the Ferguson Neighborhood Improvement Program over ten years, $250,000 for an environmental mitigation fund and $700,000 for community impact mitigation and emergency services. Opposition continued from residents, the St. Louis County NAACP and the Ferguson-Florissant School District; the mayor said he would vote against the plan. On 22 September 2026 the Ferguson City Council approved the revived redevelopment agreement 4-3. Residents launched a petition drive on 23 September 2026 to force a referendum on the agreement, and opponents said they are exploring legal options. KSDK reported on 2 October 2026 that opponents are gathering signatures for a referendum petition that would force the council to repeal the approving ordinance or put it to a public vote, with a signature deadline later in October 2026, and that a recall effort is also underway. KSDK describes the project (Project Butterfly, developer Jim Onder of SSL Investments LLC, 217 acres at 8000 West Florissant Avenue) as a Chapter 100 package that could scale to $22 billion over time, with an initial investment above $175 million. | ~$1.8B | |

| Benton County data center moratoriummoratorium Signed 10 August 2026; six months to 10 February 2027; enforcement enjoined 6 October 2026 | n.a. | Benton County Commission | The Benton County, Missouri, Commission signed a six-month data center moratorium on 10 August 2026, running to 10 February 2027. Developer Trent Overhue, through NSI6 LLC, challenged it in court; he testified he chose the county because it has no planning and zoning. A temporary restraining order was granted on 8 September 2026, Overhue closed on a roughly 12-acre site on old Highway 65 on 9 September and began clearing it, and on 21 September 2026 the judge extended the restraining order while considering a preliminary injunction (see the separate litigation row). A preliminary injunction granted on 6 October 2026 in the NSI 6 lawsuit (row 767) bars the county from enforcing the moratorium until a final judgment. | n.a. | |
| Benton County data center moratorium lawsuit (NSI6 LLC)litigation TRO granted 8 September 2026; extended 21 September 2026; preliminary injunction granted 6 October 2026 | NSI6 LLC (Trent Overhue) | Benton County Circuit Court | Developer Trent Overhue's NSI6 LLC sued the Benton County, Missouri, commissioners over the county's six-month data center moratorium signed 10 August 2026. A temporary restraining order was granted on 8 September 2026, and Overhue closed on the roughly 12-acre site on 9 September and began clearing land. At a hearing on Monday 21 September 2026 on a preliminary injunction to keep the county from enforcing the moratorium, the judge extended the temporary restraining order and urged caution about construction until a final decision. The county argues the moratorium is valid because the company was not formed until 13 August 2026, three days after the moratorium. On Tuesday 6 October 2026 Senior Judge Jacqueline Cook granted a preliminary injunction barring the Benton County Commission from enforcing the moratorium until final judgment, finding the ordinance relied on no findings or data that data centers pose a health risk and that NSI 6 has a sufficient probability of success. NSI 6 plans a data center on a 12-acre site at U.S. Route 65 and Dam Access Road in Warsaw. No further hearings were scheduled. | n.a. | |
| Camdenton AI data center moratorium (opportunity zone support rescinded)moratorium Approved 5 May 2026; up to 12 months; single outlet | n.a. | Camdenton Board of Aldermen | The Camdenton Board of Aldermen approved a temporary moratorium on Tuesday 5 May 2026, giving the city up to 12 months to decide how to regulate AI data centers. At the same meeting the board rescinded its letter of support for an opportunity zone that residents had linked to a data center. Police turned away about 25 people because the room had reached its occupancy limit. | n.a. | |
| Columbia data center moratoriummoratorium Enacted May 2026 | n.a. | Columbia | Columbia, Missouri, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated May 2026. 1-year moratorium pausing data center permits and conditional-use applications, 6-0. Council approved data center definition and zoning criteria simultaneously. The measure has a stated duration whose end date is not recorded. | n.a. | |
| Independence data center moratoriummoratorium Moratorium passed July 2026 per KCTV (tracker date January 2026), in effect through 2 January 2027; major data center rules adopted 6-0 on 5 October 2026 | n.a. | Independence | Independence, Missouri, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated January 2026. 180-day moratorium on new data center and battery energy storage permits. Does not affect previously approved Nebius project. The measure runs to 2 January 2027. On Monday 5 October 2026 the Independence City Council voted 6-0 to require council approval of major data centers (electrical load above 5 MW), with a 1,000-foot setback from homes, schools, parks and other sensitive uses, closed-loop cooling and limits on generator testing. KCTV reports the six-month moratorium was passed by the council in July 2026 and remains in effect through 2 January 2027. The rules do not affect the Nebius campus. | n.a. | |
| Jackson County 180-day data center and battery storage moratoriummoratorium Passed 8-0 on 22 June 2026; 180 days | n.a. | Jackson County Legislature | The Jackson County Legislature voted 8-0, with one member excused, on 22 June 2026 to pass a 180-day moratorium on data center and battery energy storage land-use applications. The county will develop regulatory standards and public notification requirements during the pause. The county executive had 10 days to sign or veto. | n.a. | |
| Montgomery County data center Sunshine Law suitlitigation Suit filed February 2026; motion to dismiss largely denied and state dismissed as a party (order dated 14 September 2026 by ABC17 and 18 September 2026 by KOMU) | n.a. | Cole County Circuit Court | Preserve Montgomery County, LLC sued Montgomery County and the Missouri Department of Economic Development in February 2026 in an effort to halt the Amazon data center east of New Florence, alleging inadequate public notice and disclosure of water and electricity use and tax abatement terms. Cole County Circuit Judge Cotton Walker denied the defendants' motion to dismiss most of the case, finding the group has standing, but dismissed its claim that the department failed to monitor an American Rescue Plan Act grant agreement and removed the department as a party. The case continues against Montgomery County. KOMU dates the order Friday 18 September 2026; ABC17 dates it Monday 14 September 2026. | n.a. | |
| Nebius Independence AI factory (Bly Road)litigation Lawsuit filed 13 August 2026; TRO hearing set for 22 October 2026 | Nebius Group (Missouri ADC Holdings LLC) | City of Independence | Four residents affiliated with the Independence Guard Alliance filed a lawsuit on 13 August 2026 asking a Jackson County judge to halt construction of the Nebius data center on Bly Road. The suit names Missouri ADC Holdings LLC and challenges City Council actions before its 2 March 2026 vote approving more than $6 billion in tax breaks and other funding mechanisms. Plaintiffs allege violations of the Independence City Charter and the Missouri Sunshine Law. Nebius broke ground in May 2026 and construction was continuing when the suit was filed. A motion hearing on a temporary restraining order to halt construction, sought by the Independence GUARD Alliance and residents who allege permit violations, is set for Thursday 22 October 2026 in the Eastern Jackson County Courthouse. | n.a. | |
| Nodaway County six-month data center moratorium (White Cloud Acres)moratorium Approved unanimously 21 July 2026; six months; single outlet for the vote (KXCV-KRNW) | Scale Microgrids (formerly ReLoad Energy) | Nodaway County Commission | Nodaway County commissioners unanimously approved a six-month moratorium on building data centers at their 21 July 2026 meeting, after 30 minutes of public comment. The order covers the construction or establishment of a data center or any supporting or ancillary facility in unincorporated areas, and the county may seek cease and desist orders for violations. The commission said the pause allows time to study the issue and to consider adopting planning or zoning. The proposed White Cloud Acres site has no announced occupant, and the developer holds an option on the land but has not bought it. | n.a. | |
| Oak Grove data center moratoriummoratorium Enacted August 2026 | n.a. | Oak Grove | Oak Grove, Missouri, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated August 2026. Board of Aldermen enacted one-year moratorium on data center proposals; preemptive, no active proposals. The measure runs to 5 August 2027. | n.a. | |
| Pacific data center moratoriummoratorium Enacted August 2026 | n.a. | Pacific | Pacific, Missouri, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated August 2026. Board of Aldermen unanimously approved 12-month moratorium on data center applications; followed opposition to proposed 500-acre data center near Crooked Creek Farm. The measure runs to 4 August 2027. | n.a. | |
| Palmyra data center moratoriummoratorium Enacted September 2026 | n.a. | Palmyra | Palmyra, Missouri, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated September 2026. | Ralls County data center moratoriummoratorium Enacted January 2026 | n.a. | Ralls County | Ralls County, Missouri, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated January 2026. Commissioners signed a one-year moratorium on economic development projects and data centers after learning a property owner may have signed a deal to sell 53 acres to a data center company. Commissioners want voters to decide on the April ballot whether the county should allow data centers. The measure runs to 20 August 2027 and applies at a threshold of 53 acres. | n.a. | |
| Springfield 120-day data center administrative delaylitigation Passed 29 June 2026; 120 days to 17 November 2026; developer suit filed 17 September 2026; related rezoning application withdrawn 1 October 2026 | n.a. | City of Springfield | Springfield City Council passed a 120-day administrative delay on data center projects 8-0 on 29 June 2026 (Ordinance 28306), expiring 17 November 2026. Staff will evaluate land use compatibility, electric, water and wastewater impacts, and noise and air impacts, and hold public open houses before reporting to the Planning and Zoning Commission and council; City Manager David Cameron has indicated staff will seek an extension. On Thursday 17 September 2026 NSI A.1 LLC, affiliated with developer Trent Overhue, filed a 31-page, six-count petition in Greene County Circuit Court before Judge Nathan Taylor to invalidate the delay. The petition argues the measure is interim zoning adopted without the required public hearing and 15 days' published notice, that it was filed as a resolution in conflict with the City Charter, and that the city violated the Sunshine Law. Overhue's pre-development application proposes a high-performance computing facility in the basement of a former medical office building at 2900 S. National Ave.; an electric service application to City Utilities listed anticipated demand of 9.9 MW and was not processed because of the delay. On Thursday 1 October 2026 the rezoning application for 2900 S. National Ave. (to C-MX2 for a veterinary clinic, with no mention of a data center), which had been postponed to the 15 October Planning and Zoning Commission meeting, was withdrawn. Overhue said he had only authorized a conditional allowance for a veterinary tenant while pursuing his original basement data center plan. The News-Leader reports the City Council is likely to extend the pause beyond mid-November; Overhue's suit against it remains pending. | n.a. | |
| St. Charles County six-month large-scale data center moratoriummoratorium Approved unanimously 13 July 2026; six months | n.a. | St. Charles County Council | The St. Charles County Council unanimously approved a six-month moratorium on large-scale data center developments on Monday 13 July 2026. The ordinance bars approval of new or expanded data centers larger than 100,000 square feet or with electricity demand above 5 MW while the county studies health, water, energy bill and quality-of-life impacts. The county followed the City of St. Charles, which adopted a one-year moratorium and then a data center ban in May 2026. One councilman argued for a longer or permanent pause. | n.a. | |
| St. Joseph data center application pause (6321 Pickett Road rezoning withdrawn)paused Pause decided 13 July 2026; advisory committee rejected 17 August 2026 | n.a. | City of St. Joseph | At a 13 July 2026 work session the St. Joseph City Council decided to pause acceptance of new data center applications and seek outside expertise to update the zoning code. The rezoning application for a proposed data center at 6321 Pickett Road had been withdrawn. On 17 August 2026 council rejected 3-6 a proposal to create a citizen data center advisory committee. | n.a. | |
| Western Newspaper Union building data center towerdenied Denied by the Plan Commission 5 August 2026; related development ordinance listed as pending until 13 October 2026 (reported 7 October 2026) | Revitalization Unlimited | City of Kansas City | Miami-based Revitalization Unlimited proposed a 384-foot, 20-story data center on the historic Western Newspaper Union building in Quality Hill. The Kansas City Plan Commission voted 6-0 to deny it on 5 August 2026. The developer could ask City Council to override, but Mayor Quinton Lucas said reversal was highly unlikely. The developer had placed a preservation easement on the building on December 31 before proposing its demolition in March 2026. TechRadar Pro reported on 7 October 2026, via Data Center Knowledge, that the tower, designed by Skidmore, Owings and Merrill, would provide 24 MW of IT capacity on about 0.23 acres, with only two of its 20 floors holding servers, at a total development cost of $183 million (about $167 million of hard costs), and would rely on 30 MW of Bloom fuel cells for primary power. A related development ordinance was listed as pending at the City Council until 13 October 2026. | n.a. | |

Policy context

## What governs a data center in Missouri

Missouri (SB 4 and PSC large-load tariffs)state

SB 4 (signed 9 April 2025) requires large-load schedules for customers projected to exceed 100 MW of annual peak demand at utilities with over 250,000 customers, and 50 MW at smaller utilities. Ameren Missouri and Evergy tariffs approved; Liberty case ET-2026-0184 pending. Conditions on service, not a moratorium

Gov. Mike Kehoe signed the utility omnibus bill SB 4 on 9 April 2025, requiring the Missouri Public Service Commission to adopt large-load rates, including for data centers, that reflect those customers' share of the costs to serve them and keep other customers from bearing unjust or unreasonable costs. The PSC has approved large-load tariffs for Ameren Missouri and Evergy: customers must take service for at least 12 years with an optional five-year ramp-up (up to 17 years), meet creditworthiness and liquidity tests and post collateral equal to two years of minimum bills, give 24 months' notice to exit or pay an early termination fee on top of the exit fee, and pay a monthly demand charge of at least 80% of the contracted level, with optional customer-funded clean and nuclear capacity programs. Liberty Utilities' large-load tariff case (ET-2026-0184) is in progress.

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.

Open the scarcity tracker →

Have a specific address? Site Intelligence reads all seven references against one location, county, utility and grid operator included, and cites every finding.
