| --- | --- | --- | --- | --- | --- |
| Tract Northern Nevada portfoliolitigation 2026; disqualification motion argued before Judge Scott Freeman, reported 30 September 2026 (single outlet), no ruling yet | Tract | Storey County / Washoe County | Tract has purchased more than 12,000 acres across northern Nevada; company says it never sought subsidized costs and committed nearly $1B toward NV Energy infrastructure. Related to Tract's earlier land dispute victory against Switch in Reno. Washoe County District Judge Scott Freeman heard arguments on Tract's motion to disqualify NV Energy attorney Adam Hosmer-Henner from the utility's lawsuit against Tract; Tract claims the attorney's firm previously obtained its confidential data. No ruling was reported. | $1.0B | |
| Fallon Paiute-Shoshone Tribe data center moratoriummoratorium Enacted May 2026 | n.a. | Fallon Paiute-Shoshone Tribe | Fallon Paiute-Shoshone Tribe, Nevada, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated May 2026. First tribe in Northern Nevada to ban data centers on tribal lands; resolution brought by tribal council secretary Philip Johnson. The measure has no end date by design. | n.a. | |
| Henderson 180-day data center moratorium proposal (declined)other Moratorium declined 21 July 2026 | n.a. | City of Henderson | On 21 July 2026 the Henderson City Council declined a proposed 180-day moratorium on new data center applications. Council instead directed staff to strengthen the development agreement framework so future applicants must address water consumption, electrical demand, noise and site-specific concerns. Officials noted new projects could see effective delays while the framework is developed. | n.a. | |
| Humboldt County data center moratoriummoratorium Enacted July 2026 | n.a. | Humboldt County | Humboldt County, Nevada, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated July 2026. Temporary moratorium on data center applications through 13 July 2027 while the county updates land-use rules on water, power and infrastructure; multiple developers had approached the county and its code did not address data centers. The measure runs to 13 July 2027. | n.a. | |
| Hyperscale data center and natural gas plant on BLM land near Henderson (Paradise Hills area)withdrawn Application filed November 2025; withdrawal announced 24 September 2026 | Skylar Opportunities LLC (affiliate of Skylar Capital Management) | Bureau of Land Management / City of Henderson | A Texas-based developer canceled a proposed 1,000 MW hyperscale data center and natural gas plant on 680 acres of BLM land near the southeastern tip of Henderson, close to the Paradise Hills community. In a statement on Thursday 24 September 2026 the developer said it had consulted with the city and BLM and withdrew its application because of the city's planned urban development in the same area. Skylar Opportunities LLC is an affiliate of Skylar Capital Management, the company behind the Boulder City Townsite project on BLM land (row 180). | n.a. | |
| Pahrump Valley data center ban (Nye County Bill No. 2026-11)moratorium Adopted 18 August 2026; developer petition for judicial review filed September 2026 (reported 24 and 25 September 2026) | n.a. | Nye County | County commissioners voted 5-0 on 18 August 2026 to adopt Bill No. 2026-11, amending Nye County Code Title 17 to prohibit data center development in the Pahrump Valley and Hydrographic Basin 162, an over-appropriated basin. A separate motion setting a 14 September 2026 public hearing on land use standards for data centers elsewhere in the county passed 4-1. A proposal to put the ban to a special election died without a motion. Earlier in September 2026 CDDC, LLC and 9 of a Kind, LLC, which own nearly 911 acres along Carpenter Canyon Road and State Route 160 planned for the Manse Technology Campus (MTC Project), petitioned the Nye County district court to reverse the ban (Ordinance No. 631), allow the project to proceed and award attorney's fees, arguing the ordinance disregarded their investment made in reliance on existing zoning and violated their property rights. Commissioner Ian Bayne, who proposed the ban, said he remained confident in it. No initial court date had been scheduled as of 25 September 2026. | n.a. | |
| Pyramid Lake Paiute Tribe data center moratoriummoratorium Enacted August 2026 | n.a. | Pyramid Lake Paiute Tribe | Pyramid Lake Paiute Tribe, Nevada, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated August 2026. Tribal Council passed permanent ban on data centers on tribal homelands; Chairman Steven Wadsworth cited water sovereignty and protecting endangered cui-ui fish. Part of Water Over Data Alliance tribal coalition demanding free, prior, and informed consent for data centers in Truckee River watershed. The measure has no end date by design. | n.a. | |
| Reno citywide data center moratoriummoratorium Final moratorium approved 6-1, reported 1 June 2026; runs through 31 August 2027 | n.a. | City of Reno | The Reno City Council voted 6-1 to adopt a pending moratorium at a 14 May 2026 special meeting, then approved the final moratorium 6-1 in early June 2026. The moratorium runs through 31 August 2027 and cannot be lifted until new regulations are adopted. Council directed staff to draft rules on water and energy use, noise, air quality, community benefits and allowed locations. Already permitted data centers are not affected. | n.a. | |
| Townsite Data Centercourt halt BLM right-of-way amendment approved 26 June 2026; IBLA stay issued 1 September 2026; BLM motion to set aside and remand filed 21 September 2026; Boulder City response due 5 October 2026 | Townsite Solar 2 LLC | Boulder City area, Clark County | The Interior Board of Land Appeals stayed construction of the Townsite Data Center on 1 September 2026, an 88.5-acre facility the Bureau of Land Management approved on public land roughly 25 miles southeast of Las Vegas near Boulder City, and reported as the first AI data center approved on federal public land. The board found BLM likely acted unlawfully when it amended an existing right-of-way grant in June 2026 to permit a data center without a project-specific environmental review. Opponents cited projected electricity and water demand, soil disruption, light pollution and habitat loss for the Mojave desert tortoise. BLM had until 21 September 2026 to respond. This is an interim stay, not a final decision, and no capital figure has been disclosed. In a filing on Monday 21 September 2026, BLM asked Interior Board of Land Appeals Administrative Judge David Gunter, who granted the stay, to set aside its approval of the right-of-way amendment so the agency can conduct additional review of the application. Townsite Solar 2 LLC supports the motion, the Center for Biological Diversity and the Sierra Club are neutral, and Boulder City opposes it, with its response due 5 October 2026; the city said the motion does not commit BLM to an environmental assessment or public involvement and its approval would lift the stay. | n.a. | |
| Trammell Crow Bentonite Avenue data center complex (Henderson)withdrawn City notified March 2026; reported 3 August 2026 | Trammell Crow Co. | City of Henderson | Henderson officials said a data center complex approved by the Planning Commission in November 2025 is no longer moving forward. Trammell Crow Co. had received a conditional use permit and design review with a six-year approval period for five buildings on 157.3 acres. The city said a real estate agent told it in March 2026 that the project was off and the owner, Eldorado Hills LLC, was looking to sell for traditional industrial development. No further data center applications have been filed for the site. | n.a. | |
| Wells data center moratoriummoratorium Enacted June 2026 | n.a. | Wells | Wells, Nevada, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated June 2026. Small rural city (Elko County) approved moratorium on data center approvals pending staff recommendations. The measure has no documented term. | n.a. | |
| White Pine County data center moratoriummoratorium Enacted July 2026 | n.a. | White Pine County | White Pine County, Nevada, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated July 2026. Policy context

## What governs a data center in Nevada

Nevada (Executive Order 2026-005)state

Conditions on new tax abatement applications not yet reviewed by the GOED Board; existing abatements unchanged. Not a moratorium

Governor Joe Lombardo signed Executive Order 2026-005, setting the Nevada Standard for Responsible Data Center Development, on 17 September 2026 bars GOED abatement applications from going to the Board unless the developer pays the Local School Support Tax in full and signs a Nevada Community Support Commitment covering local water standards, paying the full cost of service without shifting it to ratepayers, and curtailing load in grid emergencies. GOED is to publish standard terms by 6 November 2026 and the Nevada Office of Energy a Responsible Speed to Power Plan by 31 December 2026. The Nevada Independent reported $236 million in missed school support taxes and $461 million in expected breaks over 11 years
