Capital at risk

## Blocked, delayed or restricted in New York

Every project in New York on the atlas's capital-at-risk record: the action taken, who took it, and the announced capital affected. Restarts and reversals are recorded with the same weight as blocks.

| Project | Developer | Jurisdiction | Action | Capital | Sources |
| --- | --- | --- | --- | --- | --- |
| STAMP campus (Stream)litigation Lawsuit filed 1 July 2025; revised GCEDC application March 2026; town awaiting revised plans as of 14 September 2026 | Stream U.S. Data Centers (via Genesee County Economic Development Center) | Town of Alabama, Genesee County (STAMP industrial park) | 2.2M sq ft facility; $1.46B in requested state/local sales tax breaks ($716M state + $716M local); Hochul had previously called it a 'local decision' she wouldn't override (March 2026) before reversing via executive order. The Batavian described Stream's STAMP data center, Project Double Reed, as a $19.46 billion project with North and South campuses. The town of Alabama was awaiting revised plans as of 14 September 2026 after the state DEC took the position that STAMP development is no longer grandfathered from new wetland rules, which the Genesee County EDC contested in a 24 August 2026 letter. Separately, Plug Power and Stream amended their Gateway land sale on 9 July 2026, fixing the price at $142 million, allowing an interim land closing and extending the outside closing date to 31 March 2027 The Genesee County Economic Development Center board voted on 2 July 2026 to prepare resolutions approving the State Environmental Quality Review for the Stream data center, with a vote planned for a July special meeting ahead of a 3 August Alabama Planning Board meeting. GCEDC never called that meeting, the planning board meeting was canceled, and no approval vote appeared on the agendas for its late July meetings. Gov. Kathy Hochul signed an executive order on 14 July imposing a yearlong moratorium on new hyperscale data centers and has criticized GCEDC's plan to provide Stream with $1.44 billion in subsidies The $6.3B and 250 MW figures are superseded. Stream's revised application to the Genesee County EDC in March 2026 raised the Project Double Reed investment from $11.1 billion to $19.461 billion for a 500 MW, 2.2 million square foot, three-building facility and raised the requested tax abatements from $774 million to about $1.4 billion (The Daily News, 5 and 12 March 2026). The July 2025 lawsuit coverage described the earlier plan at 250 MW and 900,000 square feet. The Batavian still cited $19.46 billion with North and South campuses on 14 September 2026 | $19.5B | |
| Riverview Innovation & Technology Campuspaused Paused 3 June 2026; town one-year moratorium 4 August 2026 | Riverview | Town of Tonawanda, Erie County | Application "on hold" due to NYISO backlog The Town of Tonawanda approved a one-year moratorium on 4 August 2026 blocking permits for data centers with 20 MW or more of peak demand. | $2.0B | |
| Wildflower Yaphank data centermoratorium Moratorium 16 July 2026, 18 months | Wildflower | Town of Brookhaven | The Brookhaven Town Board unanimously approved an 18-month data center moratorium on 16 July 2026, running to about January 2028. The pause covers the proposed 176 MW, $1 billion Wildflower project in Yaphank warehouses, which also falls under New York's statewide moratorium on data centers of 50 MW or more announced two days earlier. Opponents cited water use, emissions from 78 proposed generators and noise. | $1.0B | |
| All new hyperscale DCs ≥50 MWmoratorium Jul 14 2026 | n.a. | New York (statewide) | Executive Order 62 - DEC to hold in abeyance all discretionary permits for construction or expansion of data centers until DPS files a final GEIS; first statewide moratorium in the nation; ~12 GW of DC load in the NYISO queue as of May 2026, >8 GW added in 2025 | n.a. | |
| Canton data center development moratoriummoratorium Enacted 8 July 2026; length not reported | n.a. | Town of Canton Town Board | The Town of Canton enacted a moratorium on data center development on 8 July 2026. The town board later formed a Data Center Committee, led by councilors Randy Brown and Greg Kiah, to research how other municipalities regulate data centers and what local rules may be needed. Potential data center development was also under discussion in nearby Massena and Potsdam. | n.a. | |
| Clarkstown six-month building moratorium including AI data centersmoratorium Enacted shortly before 17 September 2026 (reported 17 September 2026); six months, extendable six months | n.a. | Town of Clarkstown Town Board | The Clarkstown Town Board enacted a six-month building moratorium, reported 17 September 2026, that temporarily restricts approvals for multifamily developments, large-scale subdivisions and certain commercial and industrial projects, including proposed AI data centers. The pause can be extended by up to six more months by board resolution. The town plans to review land-use rules, appoint a Community Preservation Board and survey residents. | n.a. | |
| East Fishkill data center freezemoratorium Enacted 2 July 2026; through 2029 | n.a. | Town of East Fishkill | East Fishkill enacted a freeze on data centers on 2 July 2026 that runs through 2029, according to the datacenterbans.com New York tracker. | n.a. | |
| Guilderland one-year data center moratoriummoratorium Adopted by the Town Board (Altamont Enterprise, walled, two weeks before WTEN reported it on 30 September 2026); one year | n.a. | Town of Guilderland | Guilderland adopted a one-year moratorium under which the town will not accept, process or approve applications for new data centers of any size, going beyond New York's statewide pause on projects of 50 MW or more. Town Supervisor Peter Barber said the town originally proposed six months but extended it to a year, citing energy costs, grid strain, water use and water pressure for firefighting. Existing data centers are not affected. | n.a. | |
| Islip 18-month data center moratoriummoratorium Adopted unanimously 11 August 2026; through 28 February 2028 | n.a. | Town of Islip Town Board | The Islip Town Board voted unanimously on a Tuesday, reported 11 August 2026, to ban construction of large-scale data centers for at least 18 months. The moratorium runs until 28 February 2028 and, unlike the state's 50-megawatt threshold, does not exclude facilities below a certain size. A councilman said the town needs to investigate data centers and amend its code. | n.a. | |
| LeRay data center moratoriummoratorium Enacted January 2026 | n.a. | LeRay | LeRay, New York, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated January 2026. Town board approved one-year moratorium on data centers after public hearing. Prompted by a broker marketing hundreds of acres for a data center near Watertown/Fort Drum. The measure runs to 1 August 2027. | n.a. | |
| Lysander six-month data center moratorium (Renalli Super DC proposal)moratorium Adopted 7 May 2026; six months; state moratorium status reported 29 August 2026 | Renalli Super DC, LLC | Town of Lysander | The Lysander Town Board voted on 7 May 2026 to adopt Local Law 4 of 2026, a six-month moratorium on data storage facilities, after the Planning Board recommended it 5-0 on 27 April. The action followed resident concern over a proposed 300 MW hyperscale data center by Renalli Super DC, LLC. Violations carry a $1,000 per day penalty. Reporting on 29 August 2026 said the state's one-year hyperscale moratorium does not halt local review of the proposal at 22 Hencle Boulevard. | n.a. | |
| NCCS Massena data center (town moratorium rejected)other Moratorium rejected 3-2 on 16 September 2026 | North Country Colocation Services (NCCS) | Town of Massena Town Board | The Massena Town Board voted 3-2 against a six-month moratorium on data center development after a public hearing on a Wednesday night, reported 17 September 2026. Developer NCCS has eyed land near the former Alcoa East plant and said its latest plan would draw 400 megawatts from the New York Power Authority with closed-loop cooling. An NCCS representative said the project is exempt from the statewide moratorium because it does not need additional discretionary state environmental permits. Studies funded partly through a developer escrow account must be completed before construction. | n.a. | |
| Newfield one-year moratorium on data centers and cryptocurrency miningmoratorium Approved unanimously 9 July 2026; one year | n.a. | Newfield Town Board | The Newfield Town Board unanimously approved a one-year townwide moratorium on data center and cryptocurrency mining operations at its 9 July 2026 meeting. The measure was proposed on 11 June 2026. No data center has been proposed in the town, which has no zoning; the supervisor called the pause preventative. | n.a. | |
| North Tonawanda moratorium on new or expanded data centers and crypto mining (Digihost site)moratorium Two-year moratorium adopted 16 July 2024; one-year extension approved June 2026 | Digihost (Digi Power X), existing operator affected | North Tonawanda Common Council | The North Tonawanda Common Council voted unanimously on Tuesday 16 July 2024 for a two-year moratorium on new or expanded data centers, defined to include cryptocurrency mining and AI processing, after years of noise complaints about the Digihost facility. In June 2026 the council unanimously approved a one-year extension, as the operator, now Digi Power X, proposed converting the site to an AI data center. | n.a. | |
| Orangetown data center and battery storage moratoriummoratorium Reported 25 August 2026 | n.a. | Town of Orangetown | The town board approved a six-month moratorium on applications for new data centers and battery energy storage systems, reported 25 August 2026. The town supervisor stated the moratorium does not apply to DataBank's proposed expansion, which was already in the town's environmental review. Residents raised emissions, water use and proximity to Lake Tappan. | n.a. | |
| Perth one-year data center moratoriummoratorium Adopted on a Thursday (reported 4 June 2026); one year | n.a. | Town of Perth Town Board | The Perth Town Board adopted a one-year moratorium on data centers by a 3-0 vote on a Thursday, reported 4 June 2026, with two members absent, after a public hearing at which one person spoke. The town already had a moratorium on battery energy storage systems. | n.a. | |
| TeraWulf Cayuga Data Campus (former Cayuga/Milliken power plant)litigation ZBA decision 23 December 2025; Article 78 petition filed 29 January 2026; Town Board directed drafting of a data center prohibition 29 September 2026 (not introduced or adopted) | TeraWulf (Lake Hawkeye LLC) | Town of Lansing Zoning Board of Appeals / New York State Supreme Court, Tompkins County | The Lansing code enforcement officer found the project did not comply with town zoning; the Zoning Board of Appeals ruled on 23 December 2025 that the data center is a permitted use in the industrial zone. Cayuga Lake Environmental Action Now (CLEAN) and FLX Strong filed an Article 78 petition in New York State Supreme Court on Thursday 29 January 2026 seeking to annul that decision; TeraWulf called the suit without merit. The Town Board had considered a one-year land-use moratorium in fall 2025 and withdrew it after TeraWulf threatened litigation. A petition against the project passed 20,000 signatures in June 2026, and Tompkins and Seneca counties asked the state DEC to reject a modified water withdrawal permit for the site. At a special meeting on Tuesday 29 September 2026, attended by roughly 200 people, the Lansing Town Board directed town attorney Megan Doherty to draft a local law that would prohibit data centers, with Supervisor Ruth Groff saying she favors a total ban. The board did not introduce or enact the law, has not scheduled a public hearing, and has not rejected the TeraWulf project. | n.a. | |

| Town of Mohawk six-month moratorium on data center permittingmoratorium Adopted August 2026 | n.a. | Town of Mohawk | The Town Board adopted a local law imposing a six-month moratorium on permitting or installing data centers, running through Feb. 13, 2027, while officials draft zoning laws. Town officials acted after concluding the state's hyperscale threshold of 50 MW did not reach the scale of project they were concerned about. | n.a. | |
| Town of Oneonta 12-month moratorium on AI data centers and crypto mining (Eco-Yotta site, County Road 9)moratorium Approved unanimously, reported 15 May 2026; introduced 11 March 2026; 12 months | Eco-Yotta Inc. | Oneonta Town Board | The Oneonta Town Board introduced a 12-month moratorium on 11 March 2026, held a public hearing in April, and voted unanimously for it in mid May 2026 (reported 15 May 2026). Supervisor Will Rivera cited a petition of more than 700 residents and said the board hopes to ban data centers after the pause. WKTV reported the local law still needed filing approval from the Department of State to take effect. | n.a. | |
| West Seneca one-year data center moratorium (20 MW and above)moratorium Adopted 4-0 on 28 September 2026; expires end of August 2027 | n.a. | Town of West Seneca Town Board | The West Seneca Town Board voted 4-0 on Monday 28 September 2026 to adopt a local law imposing a one-year moratorium on the construction of data centers of 20 MW or more, a lower threshold than the state's 50 MW moratorium. Supervisor Gary Dickson said no one had approached the town about a data center. The moratorium expires at the end of August 2027 and may be extended. | n.a. | |

| TeraWulf + Morgan Stanley + Fluidstack + GoogleNotes fund expansion at the Lake Mariner campus in Barker, New York. | senior notes | $3.2B | priced October 16, 2025; closing October 23, 2025 | Lake Mariner campus | |
| Blockfusion USA, Inc. + North East Data, LLC + CoreWeaveBlockfusion's subsidiary North East Data, LLC entered a definitive 15-year anchor lease with two five-year renewal options, plus a companion expansion agreement, with CoreWeave at its Niagara Falls, New York campus. The agreements convert a non-binding letter of intent announced 30 June 2026. Blockfusion is pursuing a business combination with Blue Acquisition Corp. that would list the combined company on Nasdaq. Blue Acquisition Corp.'s Form 8-K filed 22 September 2026 discloses a Series A common stock purchase warrant dated 4 September 2026 issued by Blockfusion to CoreWeave, Inc. for 2,786,624 Blockfusion Series A shares at an initial exercise price of $7.6898 per share. Under the Sixth Amendment to the business combination agreement, signed 21 September 2026, that warrant is cancelled immediately before the merger and replaced by a warrant for 2,870,813 shares of the listed company's Class A common stock at $7.4643 per share; the amendment also raises the earnout to up to 15,000,000 shares. The filing does not state the lease value or MW. An updated Blue Acquisition Corp. and Blockfusion investor presentation, furnished on Form 8-K on 25 September 2026, states the site has 50 MW energized with an expansion path to 300 MW or more, the CoreWeave expansion framework reaches up to 300 MW with CoreWeave holding first right to each increment, and CoreWeave committed $50 million as a non-recurring charge plus $30 million through the warrant purchase. Blockfusion is valued at $450 million pre-money in the business combination. | lease | ≥$2.8B | Announced 16 September 2026 | Niagara Falls AI campus | |
| H5 Data Centers + YahooH5 acquired Yahoo's Lockport, New York facility in a sale-leaseback estimated at $49M, with Yahoo signing a five-year lease. | acquisition | ~$49M | closing December 30 | H5 Lockport facility (former Yahoo) | |
| Blockfusion USA, Inc. + Blue Acquisition Corp. + Blockfusion Digital Infrastructure, Inc. (Pubco)Blockfusion, owner of the Niagara Falls, New York campus leased to CoreWeave, plans to go public through a business combination with the SPAC Blue Acquisition Corp. The latest amendment raises the earnout to up to 15 million shares at $13, $15 and $17 price thresholds and excludes a CoreWeave warrant for 2,786,624 Blockfusion shares from certain calculations. The investor presentation models about $200 million of proceeds to Blockfusion from $100 million of financing plus retained trust cash, which is an assumption, not a commitment. | other | n.a. | Backfill (not previously recorded). Business Combination Agreement signed 19 November 2025 and amended six times in 2026; closing assumed for November 2026 in the company's investor presentation | Niagara Falls AI campus | |

Policy context

## What governs a data center in New York

New York (Executive Order 62)state

Applies to hyperscale data centers of 50 MW and above; no fixed expiration; DEC to hold in abeyance all discretionary permits for construction or expansion until DPS files a final GEIS. Exempts projects already under construction, modifications of previously issued approvals, and renewals.

Signed July 14, 2026, EO 62 is the first statewide data center moratorium in the nation, against a NYISO queue of roughly 12 GW of data center load requests. New York data centers contributed $49 billion of GDP and $5.1 billion of taxes in 2024. The order holds DEC permits in abeyance until DPS completes a final Generic Environmental Impact Statement; the atlas source characterizes the duration both as having no fixed expiration and as pending that review. On 15 September 2026 Empire State Development issued the Host Community Investment Framework required by EO 62: a voluntary recommendation of $1 million per MW of utility demand in host-community investment, negotiated locally, plus Good Neighbor commitments on water, noise and lighting, prevailing wages and local hiring, annual reporting and limits on NDAs.

New York (legislative measures beyond EO 62)state

S10642: 12-month moratorium with labor standards, awaiting the Governor. A separate legislature-passed bill would bar projects of 20 MW or more and impose near-total renewable-energy requirements by 2050 on projects larger than 1 MW. A February 2026 bill would freeze state and local approvals for any new data center above 20 MW for three years.

The Legislature passed a more expansive 12-month moratorium than EO 62, and additional bills target 20 MW and even 1 MW thresholds. IBEW Third District VP Frank Muia warned a blanket moratorium "risks sending billions of dollars in private investment… to neighboring states".

New York local actionscity

Local New York actions include Newfield (Jul 2026), East Fishkill (Jun 2026), Perth one-year moratorium (Jun 4, 2025), Oneonta (May 2026), Lysander six-month pause (May 7, 2026), and a Dryden ban (Feb 2026). The C.4 summary records 12 to 13 tracked New York actions.

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.

Open the scarcity tracker →

Have a specific address? Site Intelligence reads all seven references against one location, county, utility and grid operator included, and cites every finding.
