Capital at risk

## Blocked, delayed or restricted in North Carolina

Every project in North Carolina on the atlas's capital-at-risk record: the action taken, who took it, and the announced capital affected. Restarts and reversals are recorded with the same weight as blocks.

| Edgecombe County AI data center (Kingsboro)withdrawn Withdrawal disclosed 6 July 2026; reported 15 July 2026 | Energy Storage Solutions | Edgecombe County | Developer Energy Storage Solutions withdrew its proposed $19.2 billion AI data center in the Kingsboro development area, according to the county manager at the 6 July 2026 commissioners meeting. The county board had denied a special use permit for an eight-phase, 300 MW campus on a 52-acre parcel late in 2025, which the developer appealed. At the same meeting commissioners discussed a 24-month moratorium on new data centers, with a public hearing planned for August 2026 | ~$19.2B | |
| Amazon Richmond County data center diesel generator air permits challengelitigation Air permits issued 28 August 2026; SELC contested case petitions filed Friday 25 September 2026 (News & Observer, 26 September 2026); pending | Amazon (Duke Energy holds the temporary generator permit) | North Carolina Office of Administrative Hearings (appeal of NC DEQ air permits) | NC DEQ issued two air quality permits on 28 August 2026: one to Amazon for 588 backup diesel generators and one to Duke Energy for 57 generators to power the data center temporarily until it is connected to the grid. The Southern Environmental Law Center, on behalf of the Richmond County Coalition for Justice and Black Empowerment, then filed two petitions with the North Carolina Office of Administrative Hearings asking that both permits be revoked, arguing that splitting the roughly 645 generators into two permits evades Clean Air Act requirements; SELC cites a Duke and Amazon contract giving Amazon some control over when Duke's generators run. DEQ has said the permits serve different purposes on different time horizons and belong to different companies. | ≥$10.0B | |
| Energy Storage Solutions Town of Tarborodenied September 15, 2025 | Energy Storage Solutions | Town of Tarboro | The Tarboro Town Council rejected a Special Use Permit for Energy Storage Solutions' proposed 300MW, eight-phase data center on a 52-acre site near Anaconda and McNair roads by a 7-1 vote. | $6.4B | |

The county previously approved a $1.7 million land sale to Quiet Data Centers Halifax for an 88 MW AI data center on 251 acres. The county attorney cautioned that a moratorium before site plan submission could expose the county to interference claims. No moratorium has been adopted. | ≥$250M | |

On Thursday 17 September 2026 Superior Court Judge John Morris granted summary judgment to ECO TIP West, finding no genuine issue of material fact, which allows the 750 MW, five-building campus on the Moncure megasite to proceed despite the moratorium unless the county appeals. Policy context

## What governs a data center in North Carolina

North Carolina (statewide)state

Duke Energy Carolinas and Duke Energy Progress operate under an NCUC proceeding on large-load integration at a 100 MW threshold; Duke's response filed July 24, 2025 to the commission's June 6, 2025 request; first semiannual major-load-addition report filed May 15, 2025. C.4 floors: 1.5 GW (Tract Mooresville) + 250 MW (Apex); $30.6B; 4 projects; 31-32 tracked actions.

North Carolina's regulatory threshold for large-load integration review is 100 MW under an NCUC proceeding. Dimetrics tracks 31 to 32 state actions including Charlotte, Durham, Asheville, a Weaverville ban, and multiple county measures. On 18 September 2026 the Utilities Commission denied Duke Energy's $584 million gas turbine at the Smith Energy Complex near Amazon's Richmond County campus for want of demonstrated need and Ratepayer Protection Pledge compliance. The denied unit was a 255 MW hydrogen-capable F-class simple cycle combustion turbine. The order said much of Duke's projected load growth appears to be based on anticipated data center customer additions and is insufficiently reliable for the Commission to act, and that the record did not establish how far the unit was meant to serve data center demand or how Duke would honor the Ratepayer Protection Pledge. Duke said it is reviewing the order and assessing next steps. On 7 October 2026 Duke Energy Carolinas and Duke Energy Progress announced a settlement with the North Carolina Public Staff, joined by Amazon, Google, Meta, Microsoft, the Carolina Industrial Group for Fair Utility Rates and the U.S. Department of Defense, on large-load service. If approved by the Utilities Commission, it applies to customers of 50 MW or more at an 80% load factor that sign electric service agreements after 1 June 2026 (Duke's prior contract protections applied at 100 MW): new large loads, including data centers, must take service under a separate High Load Factor rate schedule, make nonrefundable upfront payments for grid facilities serving only them, and post deposits and security for shared grid upgrades such as transmission. Duke said a Commission decision is expected by mid-November 2026.

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.
