| AWS 18-building campus, Trenton annexation of 601 acres from Madison and St. Clair townshipswithdrawn Annexation petition withdrawn 14 September 2026; withdrawal acknowledged by county commissioners 15 September 2026; $5 billion value Reported by the Cincinnati Business Courier | Amazon Web Services | City of Trenton and Butler County Board of Commissioners | Trenton, Duke Energy Ohio and Kentucky, Watson Gravel Inc. and two landowners filed an expedited annexation petition on 27 July 2026 to bring 601 acres into the city for a proposed 18-building AWS data center. Madison Township trustees voted unanimously on 24 August 2026 to reject the petition and St. Clair Township rejected it the next day, despite Amazon offering each township $5 million. On 14 September 2026 the petitioners withdrew the petition hours before a Butler County commissioners hearing, reserving the right to refile after Trenton voters decide a 3 November 2026 charter amendment banning data centers above 25 MW. Butler County's six-month data center moratorium for Madison and five other townships runs to December 2026. The annexation petitioners asked for postponement until after 10 November 2026. | ~$5.0B | |
| Aligned Data Centers Pataskala campusunder appeal Denied 25 August 2026; appeal filing reported 8 October 2026 | Aligned Data Centers | City of Pataskala | Pataskala City Council voted at its 25 August 2026 meeting to accept the Planning and Zoning Commission's recommendation and deny the site plan for a 200 MW, three-building campus. Council President Brandon Galik cited unresolved power questions and incomplete design. A citizen petition carrying more than 500 signatures places a potential data center ban before Pataskala voters at the November 2026 election. Separately, the Pataskala City Council voted on 3 August 2026 to place a citizen-petitioned charter amendment banning data centers larger than 25 megawatts on the 3 November 2026 ballot, and the Licking County Board of Elections certified it on 17 August 2026. Aligned Data Centers has filed court documents seeking judicial review of the City Council's unanimous 25 August 2026 denial of the 200 MW center on 89 acres at Broad and Mink streets, asking the city to file transcripts and records of meetings from December 2025 through August 2026 (reported 8 October 2026; filing date not stated). | ≥$5.0B | |
| AWS Wilmington data center emergency rezoning (Cosler Farm)litigation Emergency rezoning 3 September 2026; suit filed by 4 September 2026; trial 2 October 2026; dismissed 4 October 2026 (reported 6 October 2026); appeal planned | Amazon Web Services | City of Wilmington | On Thursday 3 September 2026 the Wilmington City Council passed ordinances as emergency measures rezoning the 471-acre Cosler Farm parcel to light industrial for a proposed $4 billion Amazon Web Services data center; emergency ordinances take effect immediately and are not subject to referendum under Ohio law. The vote was a redo after a federal judge found the city had violated open meeting rules. Resident Rachel Mary Brooks sued the city in Clinton County Common Pleas Court, arguing the declared emergency is illusory and was used to prevent a referendum; at a temporary restraining order hearing on 4 September the city agreed not to act on the rezoning for a week and not to interfere with signature gathering, and the local judge recused himself. WLWT reported that the case was set for trial at 1 p.m. on Friday 2 October 2026, and that Clinton County Citizens for Responsible Development announced on 1 October that it had gathered enough signatures for a referendum, whose fate depends on the court. No ruling was found. In a ruling issued Sunday 4 October 2026, Clinton County Judge Jonathan Hein held that the emergency clauses in the two replacement ordinances (data centers as a permitted use in light industrial zones, and the rezoning of more than 470 acres of Amazon-owned farmland) gave sufficient reasons, found the ordinances legally valid and dismissed Rachel Brooks' lawsuit. The ruling clears a legal hurdle for the $4 billion AWS project and is a setback for the referendum effort; Brooks' attorneys said they plan to appeal. | ~$4.0B | |
| Amazon Sunbury campusmoratorium Jun 26 2026 | Amazon | Sunbury, Delaware County | Sunbury has a data-center development moratorium in place until Jan 31 (2027); residents fear council could approve the $2B Amazon facility once it expires and are collecting signatures for a fall ballot charter amendment to cap data centers at 25MW peak load. | $2.0B | |
| Slavic Village hyperscale data centerrejected Permit filed 5 May 2026; rejection reported 14 May 2026 | Lakeland Equity Group | City of Cleveland | The City of Cleveland rejected a permit application, filed 5 May 2026, for a $1.6 billion data center in Slavic Village, saying the application failed zoning review. Mayor Justin Bibb's office cited serious concerns about hyperscale, standalone data centers in residential neighborhoods. Lakeland Equity Group said it was considering its options, and City Council later approved a temporary pause on new standalone data center projects. | $1.6B | |
| Oregon charter amendment capping data centers at 25 MW (Vantage Data Centers project)other Ballot certification accepted August 2026 (reported 19 August 2026); mayor's statement 28 September 2026; vote 3 November 2026 | Vantage Data Centers | City of Oregon voters (3 November 2026 ballot); Oregon City Council | United Neighbors of Oregon gathered enough signatures to place a citizen-led charter amendment limiting data centers to 25 MW on the 3 November 2026 ballot, and the city council voted unanimously in August 2026 to accept the board of elections' certification. Vantage Data Centers, confirmed as the prospective developer, presented its draft economic development agreement to council on Monday 28 September 2026, asking for approval by 26 October; the draft offers a 15-year, 100% property tax abatement with payments in lieu of taxes capped at $14 million a year per building. Mayor Steven Salander said at the meeting that he will not approve any timeline until residents vote. | ~$1.1B | |
| Three-campus program (New Albany, Heath, Hebron)paused Apr 2025; paused again Jun 2026 | Microsoft | Licking County | Cancelled Apr 8 2025; restarted 2026 (~869 MW). Construction paused again June 2026 while Microsoft reassesses cloud and AI infrastructure needs. | ≥$1.0B | |
| Urbana Technology Hub data center (Thor Equities)litigation Moratorium March 2026; zoning repealed and federal suit filed June 2026; charter ban sent to the ballot 4 August 2026; mediation 21 and 25 September 2026; settlement terms released 5 October 2026; council took no action 6 October 2026; ballot 3 November 2026 | Thor Equities | City of Urbana / US District Court for the Southern District of Ohio | Urbana City Council passed an emergency 12-month moratorium on new data centers in March 2026 and in June 2026 repealed the zoning amendment that had allowed data centers on the site. Thor Equities then sued the city, the council and the Building and Zoning Appeals Board in federal court (reported 19 June 2026), saying it had invested over $19 million and filed a site plan in February. On 4 August 2026 the council sent a citizen-initiated charter amendment banning data center construction (with an exemption under 7.5 MW for single-organization facilities) to the 3 November 2026 ballot. Court-ordered mediation sessions on 21 and 25 September 2026 produced a settlement proposal from Thor that must be approved by the city council and the court; the next council meeting is 6 October 2026. On 5 October 2026 Mayor Bill Bean released the terms of the mediated proposal, set out in a memorandum of understanding that is not final and needs City Council approval of a settlement agreement and consent decree plus federal court sign-off; council was to review it in executive session on 6 October 2026. Thor would waive damages claims the city estimates at over $115 million, pay the city up to $50 million over the life of the project (starting at the Phase One building permit, then tied to each certificate of occupancy), forgo a Community Reinvestment Area tax abatement, fund an independent environmental study including impacts on Cedar Bog and water and sewer capacity before construction, subsidize needed water and wastewater upgrades, and provide emergency management and decommissioning plans. The project would still go through site plan review, and any expansion beyond the proposal would need council's written agreement. At the 6 October 2026 meeting, attended by roughly 100 residents urging 'no deal', the City Council took no action on the proposed settlement. | ≥$1.0B | |
| West Jefferson campuscancelled Oct 2025 | Sentinel | West Jefferson | Cancelled over power limits | $1.0B | |
| AWS Cosgray campus fuel cell facility (Hilliard permit appeal)other Appeal withdrawn Tuesday 15 September 2026; reported 16 and 17 September 2026 | Amazon Web Services | Hilliard | The City of Hilliard withdrew its appeal, filed in 2025 with the Environmental Review Appeals Commission, of an Ohio EPA permit for a natural-gas-powered fuel cell facility at the Amazon data center off Scioto Darby Road. City Council President Emily Cole said the withdrawal is not an endorsement and that state law gives local communities limited authority over such facilities. The city had appealed in November 2025 after AWS withdrew its local application for 228 fuel cells, arguing state approval was sufficient because AEP Ohio could not supply the load for several years. The city plans air quality testing once the fuel cells operate. | n.a. | |
| Amazon Web Servicesdenied Sep 21, 2026 | n.a. | Wilmington, Ohio | The Ohio Supreme Court rejected a proposed ballot question that would change the zoning code and expand residents' lawsuit powers regarding data center developments. | n.a. | |
| Archbold data center moratoriummoratorium Enacted April 2026 | n.a. | Archbold | Archbold, Ohio, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated April 2026. Emergency resolution, 6-month moratorium on data centers, advanced manufacturing, and technology storage facilities. Passed 5-0. Extended another 6 months to ~April 2027 due to uncertainty around HB 646 and state study commission. The measure has a stated duration whose end date is not recorded. | n.a. | |
| Ardent/TAC data center rezoning referendum (Wilmington)other Referendum qualified, reported 17 April 2026; vote at the November 2026 general election; single outlet | Ardent / TAC (as named by WCPO) | City of Wilmington | Wilmington Residents for Responsible Development secured a referendum on the city's rezoning of four parcels from rural residential to light industrial for the Ardent/TAC data center project, which is separate from the Amazon Web Services project. Organizer Jessica Sharp said the group turned in 1,529 signatures in about 25 days. WCPO reported on 17 April 2026 that the measure will be on the November 2026 ballot for Wilmington voters; the mayor said the matter was under legal review. | n.a. | |
| Ashville EdgeConneX campus referendumlitigation Ohio Supreme Court decision 7 August 2026; ballot 3 November 2026 | EdgeConneX | Village of Ashville, Pickaway County | Ashville village council adopted a preliminary agreement with EdgeConneX in April 2026 as an emergency resolution, making it effective immediately and waiving the standard 30-day period before a referendum could be sought. Residents submitted referendum signatures in May 2026; the village fiscal officer refused to forward the petition in June 2026. On 7 August 2026 the Ohio Supreme Court decided State ex rel. McNamara-Smith v. Grube, 2026-0906, 6-1, holding that the emergency resolution did not explain why a 30-day delay would obstruct the project, and directed fiscal officer April Grube to submit the petition to the Pickaway County Board of Elections for placement on the 3 November 2026 ballot. The court noted the board of elections may still determine whether the resolution was an administrative action not subject to referendum. | n.a. | |
| Athens data center moratoriummoratorium Enacted August 2026 | n.a. | Athens | Athens, Ohio, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated August 2026. 1-year permit pause inside city limits; the mayor or service-safety director may extend it a second year. Does not reach the site that prompted it, that parcel is in Athens Township, outside the city. The measure runs to 4 August 2027. | n.a. | |
| Avon Lake data center moratoriummoratorium Enacted June 2026 | n.a. | Avon Lake | Avon Lake, Ohio, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated June 2026. Ordinance 26-60, an emergency measure effective on the mayor's approval Jun 23 and running through 22 June 2027, extendable once by up to six months. Bars consideration, approval or authorization of any data center as a permitted, conditional or accessory use, including zoning permits, building permits and certificates of occupancy, and tolls the clock on pending applications so nothing is approved by default. Excludes a data center incidental to a permitted principal use. Section 4 bars any data-center zoning framework reaching council until the city completes fiscal, infrastructure and community-impact analyses and at least two publicly noticed hearings. The measure runs to 22 June 2027 and covers permits. | n.a. | |
| Barberton open-ended data center moratoriummoratorium Approved 10 November 2025; indefinite | n.a. | Barberton City Council | Barberton City Council approved an indefinite moratorium on data centers at its 10 November 2025 meeting, after resident opposition to Quantum HPC's since-abandoned data center plan at the former PPG limestone mine in neighboring Norton. The sponsor said the city would finish its new development code first, then add data center rules and cancel the moratorium. | n.a. | |
| Berea data center permit moratorium (Ordinance 6-6)moratorium Adopted 7-0 on 15 June 2026; up to one year | n.a. | Berea City Council | Berea City Council suspended the three-reading rule and adopted Ordinance 6-6 as an emergency measure at its 15 June 2026 regular meeting, with all seven members voting yes. It imposes a temporary moratorium, not to exceed one year, on granting or issuing permits for data centers and on receiving and processing applications. Sponsors cited open questions on power supply, water supply and utility costs; the mayor noted the city has its own water source. | n.a. | |
| Bitdeer Shalersville data center (Turnpike Commerce Center)moratorium Zoning amendment adopted 6 October 2026; township moratorium in force, expires November 2026 (adoption date not reported) | Bitdeer (with Geis, Shalersville Holdings) | Shalersville Township | Bitdeer proposes a 750 MW data center (non-mining) in 15 modular buildings on 257 acres at State Route 44 and Beck Road. The township has a data center moratorium that is scheduled to expire in November 2026, and trustees say the application was never accepted. On 6 October 2026 trustees unanimously adopted a zoning amendment classifying uses of 25 MW or more as heavy industry, a zone no township property carries; developer counsel called it unlawful and said the application was filed under the old rules. Further hearings are set for 14, 15 and 20 October 2026. | n.a. | |
| Boardman Township data center moratoriummoratorium Enacted April 2026 | n.a. | Boardman Township | Boardman Township, Ohio, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated April 2026. 1-year moratorium, unanimous. Pause for zoning regulation development. The measure runs to 28 April 2027. | n.a. | |
| Braceville Township data center moratoriummoratorium Enacted June 2026 | n.a. | Braceville Township | Braceville Township, Ohio, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated June 2026. Six-month moratorium on issuing any data center permits or applications, unanimous and effective immediately. Trustee chairman Todd Garland cited noise, electricity and water use, and said the consensus among Trumbull County townships was to halt development while they study it. Reported as a Tuesday meeting, matching Jun 2. The measure runs to 2 December 2026. | n.a. | |
| Butler County (Ohio) six-month data center moratorium (six county-zoned townships)moratorium Approved mid-June 2026 (reported 16 June 2026); six months; single outlet | n.a. | Butler County Board of Commissioners | Butler County commissioners approved a six-month moratorium on data centers in the six townships under county zoning control: Hanover, Lemon, Madison, Milford, Oxford and Ross. The measure bars acceptance or processing of any permit, zoning, building or land use application for a data center or data processing center in those townships. Commissioner Don Dixon proposed it after township trustees asked for help, and the county has retained Taft Stettinius and Hollister to advise on data center regulation. | n.a. | |
| Canton Township data center moratoriummoratorium Enacted April 2026 | n.a. | Canton Township | Canton Township, Ohio, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated April 2026. Resolution 04-03-2026, moratorium on any new data center operating or locating in the township. Unanimous 3-0 vote. Third Stark County jurisdiction to freeze after Plain Township and Massillon. The measure has a stated duration whose end date is not recorded. | n.a. | |
| Chillicothe moratorium repeal (Alignment Engine former paper mill data hall)restarted Moratorium struck down 8-1 on 14 September 2026 (adopted 24 August 2026) | Alignment Engine | City of Chillicothe | Chillicothe City Council voted 8-1 on Monday 14 September 2026 to reconsider and strike down the 60-day data center moratorium it had adopted unanimously on 24 August 2026. Council members cited a newly surfaced city letter from earlier in 2026 telling the paper mill owner that the Unified Development Code did not prevent a data center on the property. The vote clears a hurdle for Alignment Engine's proposed data hall, which the company says will not seek tax abatements or draw more power or water than the former mill. A companion report says a revised moratorium grandfathering the project and setting standards, including a 100 MW cap, will be redrafted and returned to council. | n.a. | |
| Clay Township (Montgomery County) data center moratoriummoratorium Approved, reported 20 April 2026; 12 months; single outlet | n.a. | Clay Township Trustees | Clay Township trustees approved a resolution imposing a 12-month moratorium on accepting and processing applications to establish or expand data centers, reported 20 April 2026. Chair Angela Howell said the zoning commission needs time to write data center rules; the moratorium can be extended. The township offices are in Brookville, Montgomery County. | n.a. | |
| Cleveland three-month pause on new standalone data centersmoratorium Three-month pause approved 14-1 on 15 July 2026; permit application rejected May 2026 | Lakeland Equity Group (Slavic Village proposal affected) | Cleveland City Council | In May 2026 the city rejected the construction permit application for Lakeland Equity Group's proposed $1.6 billion Slavic Village data center as incomplete, and Council Member Charles Slife proposed a moratorium of up to a year. On Wednesday 15 July 2026 City Council approved, 14-1, a shorter three-month pause during which the city will not review or issue permits or approvals for new standalone, principal-use data centers or expansions of existing ones; council may extend it for up to three more months. The city says it has no hyperscale standalone data centers and existing facilities are unaffected. | n.a. | |
| Conneaut one-year data center moratorium (failed) and 25 MW charter amendmentother Moratorium failed 2-4, reported 12 August 2026; council placed the 25 MW charter amendment on the November 2026 ballot on 24 August 2026 | n.a. | City of Conneaut | Conneaut City Council voted 2-4 against a one-year data center moratorium on third reading. A separate charter amendment to limit data centers in the city to 25 MW moved to third reading. No official proposal has been made to the city, though a firm is studying a site at Conneaut East Industrial Park. After residents gathered enough signatures, Conneaut City Council approved placing the charter amendment capping data centers at 25 MW on the November 2026 ballot at its Monday 24 August 2026 meeting. | n.a. | |
| Cortland data center moratoriummoratorium Enacted June 2026 | n.a. | Cortland | Cortland, Ohio, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated June 2026. Kidd v. Clinton County Board of Elections, held that a citizen initiative to add data center regulations to Wilmington's zoning code cannot appear on the 3 November 2026 ballot because it would create a private cause of action, which a municipality cannot enact. SB Energy's Form S-1/A Amendment No. 2 (21 September 2026) states that NVIDIA has prepaid $1.5 billion under a forward contract to buy non-voting Class N common stock at 90% of the IPO price, settling on completion of the offering, and has separately committed to buy a further $1.5 billion of Class N stock in a concurrent private placement at the IPO price, contingent on and closing with the IPO. In total NVIDIA will invest $3.0 billion in connection with the offering. The amount on this record stays at $1.5 billion; the additional $1.5 billion is contingent on an IPO that was reported delayed on 21 September 2026. | equity raise | $1.5B | Announced 17 August 2026; terms restated in Form S-1/A Amendment No. 2 filed 21 September 2026 | PORTS-Pike Technology Campus | |

The company says the orders anchor the initial phases of the Ohio campus. The filing names the campus only as being in Ohio; it is linked to the atlas's Alignment Engine site in Chillicothe, the campus described in the Volato merger coverage. | compute lease | ~$1.2B | Master Services Agreement signed 22 September 2026; announced 28 September 2026 (Form 8-K) | Alignment Engine data hall (Chilpaco division, former US Paper Mill, Eastern Avenue and Canal Street) | |

Policy context

## What governs a data center in Ohio

Ohio (statewide)state

AEP Ohio data center tariff (PUCO Case 24-508-EL-ATA, approved July 9, 2025): 85% take-or-pay over 12 years for loads ≥25 MW, effective July 23, 2025. Statewide TCA tax-credit pause (May 2026). C.4 floors: ~24,300 MW of anticipated demand removed (30,000 → 5,700 MW post-tariff); 6 GW generation cancelled; $2B+ cancelled; 38 tracked actions.

Ohio's take-or-pay tariff at a 25 MW threshold collapsed anticipated data center demand from 30,000 MW to about 5,700 MW. Dimetrics tracks 38 Ohio actions including Cleveland, Cincinnati, Butler County, and a statewide tax-credit pause. The Ohio Capital Journal counted at least 138 Ohio municipalities and townships with active data center moratoriums as of 17 September 2026, 23 communities that have effectively banned data centers and at least 23 more across seven counties considering proposals; a Bowling Green State University poll released 16 September 2026 found 78% of Ohioans support moratoriums.

Ohio (PUCO 180-day notice order and State Agreement Approach request for PORTS-Pike)state

AEP Ohio data center customers must give at least 180 days' notice before connecting and pay all incremental supply costs

PUCO granted AEP Ohio's request for relief and ordered the 180-day notice so the utility can procure supply through stand-alone auctions or short-term purchases, with the data center customer covering the full cost. Separately, PUCO asked PJM to initiate the FERC Order 1000 State Agreement Approach to interconnect the PORTS-Pike Technology Campus, a 10 GW data center with co-located gas generation.

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.

Open the scarcity tracker →

Have a specific address? Site Intelligence reads all seven references against one location, county, utility and grid operator included, and cites every finding.
