| PAX-1 data center (Middlesex Township)litigation Arguments heard 18 September 2026; stay denied 22 September 2026; mandatory stay refused 5 October 2026; discretionary stay hearing 13 November 2026 | Carlisle Development Partners | Cumberland County Court of Common Pleas | Residents led by Kyler Gerber appealed the township's approval. Judge Matthew Smith heard arguments on Friday 18 September 2026 and is reviewing a 21,000-page record, with no ruling timeline announced. The project is under construction. On Tuesday 22 September 2026 Judge Smith denied the appellants' request to halt work while their appeal of the township's 6 May preliminary land development approval proceeds, writing that it does not appear from the record that the appellants have a strong likelihood of prevailing on the merits. The case was not dismissed and the judge will continue to take argument; a separate suit challenging the 2025 zoning map change remains alive, and a DEP permit appeal is pending before the Environmental Hearing Board. PennLive reports the project at full buildout would be 16 buildings with a maximum computing power of 1.35 GW. PennLive reported on 1 October 2026 that the five neighboring property owners filed a new motion asking the Cumberland County court to stay construction and further plan review. They argue that state law and township ordinances require a pause while their substantive validity (spot zoning) challenge to the May 2025 data center overlay, filed with the township zoning hearing board on 13 May 2026, remains pending because the board never acted on it; in the alternative they ask for a discretionary stay. The requested stay would not apply to a PPL substation planned on the site. No court date had been set on the motion. In a ruling on Monday 5 October 2026, Cumberland County Judge Matthew Smith declined to order construction stopped, finding that a mandatory stay applies only to hearings pending before the zoning board, but scheduled a hearing for 13 November 2026 on whether to grant a discretionary stay; at the same hearing he will consider whether the challenge is a frivolous appeal under Pennsylvania law. Township supervisors gave final approval to PAX-1 in September 2026. | $15.0B | |
| Cleveland Cliffs Steel Plant Data Centercancelled October 1, 2025 | Brian O'Neill (developer) | Conshohocken / Plymouth Township | A developer attempted to convert the Cleveland Cliffs steel plant on 66 acres of Plymouth Township's riverfront corridor into a data center for undisclosed Big Tech tenants. | $9.0B | |

Residents had organized against the plan, and the company cited its deep roots in the community. | n.a.

| Clinton Township data center campusrejected Rejected September 2026; reported 10 September 2026 | Linde Corporation | Clinton Township | Clinton Township supervisors voted unanimously to reject Linde Corporation's preliminary land development plan after roughly six months of review, reported 10 September 2026. A township engineer concluded the plan was not environmentally sound, and the board chairman said the application was incomplete. The township planning commission had accepted the resubmitted application in early July 2026, starting a 90-day review period that ran to 28 September 2026. Attorneys were to meet the developer within 15 days to review the deficiencies, leaving open the possibility of a revised submission. A township supervisor resigned in July 2026 after residents questioned ties to the developer. | n.a. | |
| Conshohocken data center at former Cleveland-Cliffs steel millwithdrawn Withdrawn 17 November 2025 | Brian O'Neill | Plymouth Township Zoning Hearing Board | The township planning board unanimously declined to recommend the proposal in October 2025. At the zoning hearing on Monday 17 November 2025 the developer withdrew the application less than an hour in, after it emerged that the agreement of sale with the property owner was not final and the applicant lacked legal standing, according to the zoning board solicitor. | n.a. | |
| Coventry Mall data center (85,987 sq ft)withdrawn Application filed 13 August 2026; withdrawn 6 October 2026 | PGOB Coventry Holdings LLC and PennMark Management Company Inc. | North Coventry Township | The developers withdrew their application to redevelop part of the former Coventry Mall with an 85,987 sq ft data center by a letter dated 6 October 2026, and the township cancelled the 22 October 2026 zoning hearing. The application, filed 13 August 2026, claimed the use was a public service facility allowed by special exception; the zoning officer found the use not permitted in the C-1 district. In February 2026 township supervisors had voted 3-2 against a separate 120,000 sq ft data center proposed off Route 724 before any application was filed. | n.a. | |
| DANKO Holdings Muncy Township data centerlitigation Appeal filed 14 August 2026; motion to quash 28 August 2026; Commonwealth Court constitutional appeal filed 25 September 2026; argument on the county appeal 6 November 2026 | DANKO Holdings II, LP / FISHLIPS, LLC | Lycoming County Court of Common Pleas | Two Muncy Township residents filed a land use appeal in Lycoming County Court of Common Pleas against the township supervisors and the developer, challenging the deemed approval of a data center conditional use application and related curative zoning amendment. They argue the township failed to hold a hearing or act within the 60-day period required by state code, and that the developer-drafted amendment amounts to spot zoning. The developer filed its application in late April 2026, hours before supervisors passed a nine-month moratorium on high-intensity data centers, and is contesting the appeal. The appeal was filed 14 August 2026 by neighbors Rae-Ellah and Sean Tetreault. Danko Holdings II, LP and Fishlips, LLC (owned by The Liberty Group) filed a motion to quash on 28 August 2026, arguing the appeal targets the deemed-denied curative amendment rather than the deemed-approved conditional use. The township asked for a remand for a conditional use hearing. Judge William P. Carlucci scheduled argument for 6 November 2026. On Friday 25 September 2026 Green Amendments for the Generations, with residents including neighbors Sean and Rae-Ellah Tetreault, filed a separate appeal in Commonwealth Court arguing that the Municipalities Planning Code provision under which the conditional use application was published as deemed approved, after the township held no hearing within 60 days, is unconstitutional and violates environmental rights and due process. The application covers three data center buildings (two 14-pod and one eight-pod), water storage and treatment and a substation near Yetter Road and John Brady Drive. | n.a. | |
| Dauphin Highlands Golf Course data centerpaused Reported on hold indefinitely 5 August 2026 | Not identified in reporting | Dauphin County | Plans for a data center at the Dauphin Highlands Golf Course site were put on hold indefinitely to allow for more community input, after residents raised concerns at a township meeting. The pause was reported on 5 August 2026. A separate $10 billion Corscale proposal sits about two miles away in Swatara Township and is not affected by this hold. | n.a. | |

The Dickson City Zoning Hearing Board had denied the developer's validity challenge on 20 May 2026 and four appeals of denied zoning permits on 27 May 2026, after the zoning officer denied the four permit applications on 17 February 2026. | n.a.
| East Whiteland Township data center moratoriummoratorium Moratorium March 2026; permanent ordinance adopted 24 September 2026 | n.a. | East Whiteland Township | East Whiteland Township, Pennsylvania, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated March 2026. 180-day moratorium, board declared parts of data center zoning 'substantively invalid' and launched curative amendment. Developer Green Fig withdrew 1.7M sq ft application in May after sustained public opposition. The measure has a stated duration whose end date is not recorded. On Thursday 24 September 2026 the Board of Supervisors voted unanimously to approve a 32-page data center ordinance, after holding a moratorium for months while it re-examined zoning. The ordinance sets separation from homes, schools, daycares, parks and churches and addresses noise, water, cooling and power; it does not affect the 1.5 million sq ft project under construction at the former Cyprus Foote Mineral site. | n.a. | |
| Gregg Township (Union County) 180-day moratorium on data center applicationsmoratorium Adopted August 2026 | n.a. | Gregg Township (Union County) | Supervisors adopted Resolution 2026-03 at a special meeting on Aug. 20, 2026, barring the acceptance, processing and approval of new data center or 'technical development' applications for a period not to exceed 180 days or until the board terminates it. (31 property owners; attorney Daniel Karpowich) | Hollenback Township Supervisors / Luzerne County Court of Common Pleas | A curative amendment that would permit data centers on the land of 31 property owners was deemed denied at a public hearing on Sunday 1 March 2026, after the applicants' attorney objected to the hearing notice and refused a continuance and the supervisors closed the hearing. The Citizens' Voice reported the rezoning request is heading to Luzerne County Court of Common Pleas. | n.a. | |

The judge vacated the injunction the next day. On 13 August 2026 the Board of Supervisors denied two extension requests and several preliminary land development plans, citing missing architectural, traffic and engineering information. O'Neill said he will appeal. On Wednesday 16 September 2026 O'Neill filed suits in the Montgomery County Court of Common Pleas challenging the board's rejection of the roughly 4.6 million sq ft campus, arguing township officials had said data centers qualify as warehouses permitted under the zoning code. In the Montgomery County Court of Common Pleas, O'Neill, represented by attorney Marc Kaplin, is asking the court to grant preliminary approval and appoint an independent referee to oversee further review. | n.a.
| Kriger / Alpesh 'Al' Patel Blakelycancelled September 12, 2025 | Kriger / Alpesh 'Al' Patel | Blakely | Developers proposed a data center campus offering up to 1.5GW of capacity on 209 acres in Blakely Borough, requiring power equivalent to the entire output of the nearby Lackawanna Energy Center gas-fired power plant. | n.a. | |

The Zoning Hearing Board set the appeal hearing for 1 October 2026. The Granville Township Zoning Hearing Board postponed the 1 October 2026 hearing on the appeal by PA Data Center Partners (through Lewistown Development LLC) after a large crowd turned out, moving it to 26 October 2026 at the Granville Fire Co. Event Center. The proposed campus is six buildings and 1.54 million sq ft on about 245.5 acres on either side of the Mifflin County Industrial Park. | n.a.

| Pennhurst data centerdenied Denied May 2026 | Pennhurst Holdings LLC | East Vincent Township | The East Vincent Township Board of Supervisors unanimously rejected the conditional use application for a 1.9 million sq ft data center with power generation and battery storage on the former Pennhurst State School site. The vote came in May 2026 at the second conditional use hearing. The developer's attorney said the company would appeal to the Chester County Court of Common Pleas, arguing Pennsylvania law requires zoning accommodation for data centers. State Sen. Katie Muth is proposing a data center moratorium. | n.a. | |
| Project Gold data center campus (Clifton and Covington townships)litigation Challenge filed 17 April 2025; settlement vacated 30 January 2026 | 1778 Rich Pike LLC (property owner JCO LLC) | Lackawanna County Court of Common Pleas / Clifton Township Zoning Hearing Board | 1778 Rich Pike filed a substantive validity challenge on 17 April 2025 claiming Clifton Township zoning unlawfully excluded data centers, then a procedural challenge on 20 June 2025 to the township's May 2025 data center ordinance. The zoning hearing board unanimously denied the challenge on 19 November 2025 and the developer appealed on 1 December 2025. Supervisors settled on 2 January 2026, but Judge Mark Powell vacated his approval of the settlement on 30 January 2026 after the zoning hearing board objected and Covington Township sought to intervene, letting an amended land use appeal proceed. | n.a. | |

The district cites the campus's proximity to its schools on Columbus Drive and asks the court to rule that the developers have no vested rights under the legacy zoning. The Times-Tribune reported the suit could halt development of the seven data centers. | n.a.
| Project Hazelnut (1,300 acres, 15 buildings)moratorium Jul 6 2026; dollar value n.a. | n.a. | Hazle Township | 180-day curative-amendment moratorium | n.a. | |
| Salem 3 data center overlay (Salem Township)litigation Ruling 25 August 2026; repeat vote 27 August 2026; third recommendation 24 September 2026; supervisors in October 2026 | 4-3 Glennbrook Group | Luzerne County Court of Common Pleas and Salem Township Planning Commission | Luzerne County Judge Lesa S. Gelb ruled that the Salem Township Planning Commission violated the Sunshine Act at a July 2026 meeting on a data center zoning overlay for the Salem 3 project, after eight residents sued without a lawyer, and ordered a new meeting. The commission voted 4-0-1 on 27 August 2026 to again recommend the overlay, but that vote was later also found invalid under the judge's written order, and the commission planned a third vote. Township supervisors are expected to take up the overlay in October 2026. On Thursday 24 September 2026 the Planning Commission approved the overlay expansion for the third time, 4-0 with Susan Lynn abstaining as a landowner in the project area. The expansion covers more than 4,000 acres for 4-3 Glennbrook Group's Salem 3 project, which the Times Leader describes as a $1.4 billion data center project. The developer agreed to larger setbacks and a 65-foot maximum height. The Board of Supervisors is scheduled to take it up in October 2026. | n.a. | |
| Scranton Materials data center campus (819 Newton Road)under appeal Dismissed 2-1 on 20 January 2026; appeal filed February 2026 | Scranton Materials LLC | Ransom Township Board of Supervisors / Lackawanna County Court of Common Pleas | Scranton Materials filed a curative amendment in November 2025 to create a data center district on its quarry property. At a 20 January 2026 hearing the supervisors voted 2-1 to dismiss it for lack of testimony and evidence. The company appealed in the week of 16 February 2026, arguing the township must provide for data centers somewhere and that the supervisors acted improperly. | n.a. | |
| Smithfield Township data center moratoriummoratorium Enacted May 2026 | n.a. | Smithfield Township | Smithfield Township, Pennsylvania, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated May 2026. The final vote was scheduled for 17 September 2026. As drafted, the ordinances would treat data centers and accompanying power plants as conditional uses in the heavy and light industrial districts, require data centers to sit 200 feet from property lines and 400 feet from occupied homes and power plants 500 feet and 1,500 feet respectively, and cap noise at 55 decibels by day and 45 at night measured at the nearest property line. The township began drafting the ordinances after being approached by Nadara. | n.a. | |
| Stonebridge Associates Powder Mill Works data center (North Beaver and Mahoning townships)denied North Beaver appeal denied on a Thursday, reported 11 September 2026; Mahoning appeal denied on a Tuesday, reported 15 and 17 September 2026 | Stonebridge Associates (S.S. Penn LLC) | North Beaver Township and Mahoning Township zoning hearing boards | The North Beaver Township Zoning Hearing Board voted 4-0 and the Mahoning Township Zoning Hearing Board voted 2-0 to deny appeals by Stonebridge Associates affiliate S.S. Penn LLC, which challenged the townships' rejection of its June 2026 preliminary land development applications as incomplete. The rulings mean the project faces the stricter data center ordinances the townships adopted after the filing. A Lawrence County judge ruled against Stonebridge's related lawsuit in July 2026, and that decision is on appeal to Commonwealth Court. The company has 30 days to appeal the zoning board rulings to county court. | n.a. | |
| Sugarloaf Township data center curative amendment appeal (Tomhicken Road, 185 acres)litigation Appeal filed June 2025; LBT withdrew, disclosed 24 September 2026; ruling allowing Sugarloaf Logistics to continue reported 30 September 2026; single outlet | Sugarloaf Industrial and Logistics Holding, L.P. (originally LBT Investment Group LLC) | Sugarloaf Township / Luzerne County Court of Common Pleas | Township supervisors rejected zoning amendments proposed by Chicago-based LBT Investment Group for a six-data-center complex, and LBT appealed to the Luzerne County Court of Common Pleas in June 2025. In court on Thursday 24 September 2026 attorneys said LBT had backed out, while the landowner and prospective buyer Sugarloaf Logistics continue to seek a curative amendment allowing data centers. In a ruling reported 30 September 2026, Judge Lesa S. Gelb let Sugarloaf Logistics continue as plaintiff and denied intervention by the landowner partnership; the zoning question remains undecided. Supervisors tabled a resolution to write data center rules earlier that week while the case is pending. | n.a. | |
| TECfusions Keystone Connect Building J land development appeallitigation Plan approved 5 August 2026; appeal filed 25 August 2026; moratorium ends 2 November 2026 | TECfusions | Westmoreland County Court of Common Pleas | Protect PT and two New Kensington residents filed a land use appeal in Westmoreland County Court of Common Pleas challenging the Upper Burrell Township supervisors' 5 August 2026 approval of a land development plan for TECfusions' Building J. The plaintiffs argue the developer should first have been required to obtain a special exception from the zoning hearing board. The township's 180-day moratorium on new data center development, adopted in May 2026, did not cover permits already granted for Building J and ends on 2 November 2026. TribLIVE reported the appeal was filed on 25 August 2026 in Westmoreland County Court by Protect PT and Upper Burrell residents Allen Uhler and Guy Fuller, arguing a data center is not an authorized use and TECfusions should have gone to the zoning hearing board. | n.a. | |
| Warrington Township data center moratoriummoratorium Enacted January 2026 | n.a. | Warrington Township | Warrington Township, Pennsylvania, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated January 2026. Resolution 2026-09: curative amendment under PA MPC Section 609.2. York County (not Bucks). Administrative pause since Mar 11; formally ratified May 13. The measure runs until a condition is met rather than to a date. | n.a. | |
| West Mahanoy Township 180-day data center and solar farm moratoriummoratorium Approved unanimously; reported 15 September 2026; 180 days | n.a. | West Mahanoy Township | West Mahanoy Township supervisors voted unanimously to approve a resolution invoking a six-month moratorium on data centers and solar farms. The township used the curative amendment process to declare its zoning ordinance deficient on those uses. Siana Law was hired as special counsel to draft ordinance updates covering noise, buffers, power sources, and community benefits. | n.a. | |

Policy context

## What governs a data center in Pennsylvania

Pennsylvania (statewide)state

Moratoriums in Brookville Borough and Center Township (Jun 2026); a statewide measure proposed. C.4 floors: 480 MW (AWS/Susquehanna, FERC-rejected); dollars n.a.; 3 named; 5 tracked actions.

Pennsylvania's exposure centers on the FERC-rejected Talen-Amazon Susquehanna ISA plus township moratoriums in Hazle (180-day curative amendment, Jul 6, 2026) and Muhlenberg (12-month, Feb 3, 2026).

Pennsylvania (Executive Order 2026-05 and PUC data center proceedings)state

EO 2026-05 signed 18 August 2026 applies to data centers above 25 MW peak demand: bring new power and pay its full cost, firm clean energy of 10% in 2027 rising to 32% by 2035, removal from the PA Permit Fast Track Program, and annual reporting from 1 July 2027. PUC voted 10 September 2026 to open curtailment, cost allocation and ratemaking reviews, with a tentative order on 1 October and a final vote targeted for 28 January 2027

Governor Josh Shapiro's order creates a GRID compliance path giving certified projects rolling-basis DEP review, while non-compliant applicants must obtain all local permits before state review; Shapiro called the standards legally binding. On 10 September 2026 the PUC unanimously directed staff to propose emergency curtailment updates, hold a technical conference on data center cost allocation, and form a ratemaking working group including return on equity. At its public meeting on 1 October 2026 the PUC voted 4-0 to issue a tentative order for comment (Docket No. M-2026-3064961) on how Pennsylvania should implement PJM's proposed Interim Resource Adequacy Service (Tariff Attachment DD-4) and on requiring all electric distribution companies to update their pre-emergency and emergency load control procedures so that data centers are not classified as critical load exempt from curtailment. Chairman Stephen DeFrank said the order carries out the curtailment part of the 10 September motion and that large-load cost allocation will be taken up at a technical conference in November 2026. At the same meeting the PUC approved a $56.16 million Mid-Atlantic Interstate Transmission reliability project near the Crane Clean Energy Center (Docket No. A-2026-3064369), whose cost goes into the transmission rate base.

Philadelphia (Mayor Parker data center executive order)city

No moratorium; creates a task force of city departments (Planning and Development, Sustainability, Public Health, Water, Licenses and Inspections, Clean and Green) with a report due by 30 June 2027.

Mayor Cherelle Parker signed an executive order on 16 September 2026 creating a Data Center Task Force to study the benefits and harms of data centers, including environmental, energy and economic impacts, and to recommend building requirements, fiscal measures and rules to limit pollution and noise. The order directs the task force to work with state and federal agencies to apply Governor Shapiro's GRID standards. It does not include a moratorium; the No Data Centers in Philly coalition and more than 2,600 petition signers have asked City Council for a temporary ban.

The policy layer for Pennsylvania lives in three companion references: the [Pennsylvania Data Center Moratorium Tracker](https://savrn.com/data-center-moratorium-tracker/pennsylvania) for every state measure and local moratorium on record, the [Water Tracker](https://savrn.com/data-center-water-tracker) for the water rules that touch a site, and the [Grid Operator Watchlist](https://savrn.com/data-center-grid-operator-watchlist) for the large-load rules of the RTO or utility that decides whether it can energize.

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.
