The campus's on-site gas plant air permit was pending. The pause runs until the ERCOT and Texas Water Development Board audits are complete, with a TCEQ compliance update due 19 October 2026. Anthropic is reported to be in lease talks for the campus; no lease has been finalized. | ~$2.2B

| Project Tomahawk Prosper data center (rezoning denied by Planning and Zoning Commission; withdrawn)withdrawn Denied 7-0 by Planning and Zoning Commission 1 September 2026; application withdrawn before 8 September 2026 Town Council meeting | n.a. | Town of Prosper Planning and Zoning Commission | The Prosper Planning and Zoning Commission unanimously denied a zoning change request for a proposed data center at a Tuesday night meeting after hours of public opposition, including from neighboring Aubrey residents. Commissioners cited the lack of net benefit to the town, electricity use, environmental impacts and noise, and noted data centers are not a defined use in the future land use plan. The commission also unanimously denied related amendments. The project, White Rose Partners Project Tomahawk, a US$580 million data center on 37.3 acres at Parvin Road and FM 1385, was scheduled for the Town Council on Tuesday 8 September 2026, but the developer withdrew both items hours before the meeting and the town closed the application; a revised plan would need a new application and a new Planning and Zoning hearing. | $580M | |

The city listed the project as a computing and energy research annex, similar to a data center at a smaller scale. The city confirmed on 12 May 2026 that the applicant had withdrawn the request before a city council hearing set for 2 June 2026, where it would have needed six votes. | ~$30M

| Blueprint Data Centers Taylor facilitylitigation Suit 2025; dismissed 8 October 2025; Attorney General investigation announced 17 September 2026 | Blueprint Data Centers | Williamson County District Court / City of Taylor | Five Taylor residents sued to stop a 135,000 sq ft Blueprint data center, arguing a 1999 deed restriction required the land to be held as parkland. The judge had paused work during the case, but on 8 October 2025 District Judge Ryan Larson dismissed the suit for lack of standing. The residents' group said it was filing an appeal. On 17 September 2026 Texas Attorney General Ken Paxton announced an investigation into whether the 1999 deed restriction holding the land in trust for future use as parkland was modified, released or terminated before the Taylor Economic Development Corporation sold the site to NCP Travis TPP Project, LLC for $10 million in April 2025, and said he may seek court intervention. The city said it would cooperate fully. | n.a. | |
| Circle T Data Center (Westlake)litigation TRO issued 17 August 2026, extended twice, dissolved 25 September 2026; lawsuit hearing set for 23 October 2026 | PowerHouse Data Centers | Town of Westlake / 342nd District Court, Tarrant County | On 17 August 2026 Judge Kimberly Fitzpatrick of the 342nd District Court issued a temporary restraining order, sought by The Lakes at Marshall Ridge Homeowners Association in Keller and two residents, blocking the Westlake Town Council from approving the Circle T Data Center development agreement. At a 26 August hearing the restraint was extended through 8 September 2026. Plaintiffs allege the site plan lacked required setbacks and that building height was raised from 45 to 80 feet without proper notice. Separately, the Keller City Council approved a motion to begin a 90-day moratorium process within its own limits. On 26 August 2026 Judge Kimberly Fitzpatrick of the 342nd District Court extended the temporary restraining order barring a Westlake vote on the data center development plans until a 10 a.m. hearing on 8 September 2026. The Fort Worth Star-Telegram describes the project as a 1.1 million-square-foot complex on 87.9 acres at 13580 Denton Highway, 506 feet from homes in Keller's Lakes at Marshall Ridge neighborhood, and reports the Keller City Council passed a resolution opposing the project and authorizing legal action. On 15 September 2026 the Westlake Town Council voted unanimously not to renew its police services agreement with Keller, which expires in 2028, amid the dispute. The Dallas Morning News describes Circle T as eight buildings on 88 acres. The Fort Worth Star-Telegram reported on 16 September 2026 that the judge has extended the temporary restraining order against a Westlake vote twice to allow more time to study evidence, and that the latest hearing is scheduled for 25 September 2026. On Friday 25 September 2026 Judge Kimberly Fitzpatrick dissolved the temporary restraining order that had kept Westlake from voting to approve the data center, after criticizing both sides for filing about 1,000 pages of documents the night before, and set a 23 October 2026 hearing on the Lakes at Marshall Ridge Homeowners Association lawsuit, in which the city of Keller is an intervener. Westlake said it was pleased and would continue to follow Governor Abbott's directives on data center development; Keller's mayor and an intervening resident said the suit continues. The Dallas Morning News reported on 28 September 2026 that the parties met for mediation before the 25 September hearing without reaching a settlement, and a status report said the plaintiffs' claims reached an impasse while Keller, Westlake and Circle T continue a settlement dialogue. At the 23 October 2026 hearing the judge is to decide whether the plaintiffs have standing to continue the suit. Westlake says the site has been zoned commercial and industrial since 1998, making the data center allowable by right. | n.a. | |
| Diode Ventures Cedar Creek Lake data centerwithdrawn Withdrawn 23 July 2026 | Diode Ventures | Henderson County | Kansas-based Diode Ventures withdrew its proposed data center near Cedar Creek Lake in Henderson County on 23 July 2026, saying it would not advance the site beyond preliminary planning. The Governor's office said the project did not meet the five data center standards Gov. Greg Abbott set in June 2026 directives to the PUC and ERCOT. A volunteer Save Cedar Creek Lake coalition had gathered thousands of petition signatures over water supply concerns. Henderson County has no zoning rules, so the county had no approval to deny. | n.a. | |

Planning staff are to develop guidelines on water use, power reliability, zoning, noise and lighting while the ordinance is drafted, and a work session will be held within 90 days. The moratorium ordinance itself had not been adopted. | n.a.

| Project Patriot (Knox Ranch)litigation Annexation January 2026; suit by April 2026; recall mandamus petition 17 August 2026; officials' suit against the city filed 6 October 2026 | Bilateral Energy LLC | City of Granbury | Granbury annexed the roughly 2,000-acre Knox Ranch from Hood County and rezoned it for Bilateral Energy's power generation and data center plan known as Project Patriot. Four Hood County property owners sued, alleging a Texas Open Meetings Act violation through a walking quorum during a data center tour, and the suit remained unresolved as of July 2026. On 8 July 2026 residents presented a no-confidence petition with more than 800 signatures against the city manager and city attorney. On 17 August 2026 Granbury residents petitioned the Second Court of Appeals in Fort Worth for a writ of mandamus ordering the city to validate five recall petitions against the mayor, mayor pro tem and three council members, citing Project Patriot approvals. The city had verified only 26 of more than 5,000 signatures. The court set an expedited schedule that could put recalls on the November 2026 ballot. On Tuesday 6 October 2026 Mayor Jim Jarratt, Mayor Pro Tem Bruce Wadley and Councilman Skip Overdier, all subject to the recall, filed a lawsuit against the city through Houston attorney Andy Taylor alleging fraud, forgery and other defects in the recall petition; the suit put scheduling of the recall election on hold. | n.a. | |
| Project Red and Project Yellowlitigation Dismissed July 2026 | National CRE Holdings LLC; Greenland Capital LLC | Hood County | The developers of two proposed Hood County data center campuses sued, arguing their plans were automatically approved because the county missed a 30-day statutory deadline. On 2 June 2026 the mayor said MSB Global would be phased out, and the council re-adopted the letter of intent and Chapter 380 agreement to address the open-meetings claims. On 7 July 2026 Judge Dan Moore heard Vistra's Rule 91a motion to dismiss six of the city's 11 counts; the September 2026 trial date was vacated and trial is likely in 2027. | Texas enforcement directive on data center water-use reportingother Directive announced 14 September 2026; update due 14 October 2026 | n.a. | State of Texas | Gov. Greg Abbott announced on 14 September 2026 that he directed the Texas Water Development Board to use its enforcement authority against data centers that fail to complete the state's mandatory water use survey, both for past failures and future noncompliance. Existing law makes failure to respond a Class C misdemeanor, and the directive includes referring violations to county or district attorneys. Response rates were 32% of 22 surveyed data centers in 2023, 28% of 67 in 2024 and about 30% of 329 in 2025. Abbott asked the board for a compliance and enforcement update by 14 October 2026. | n.a. | |
| Texas statewide halt on TCEQ permits for data centers pending ERCOT and TWDB auditspaused Directive issued 21 September 2026; TCEQ compliance update due 19 October 2026; runs until the ERCOT and TWDB audits are complete | n.a. | State of Texas (Office of the Governor; Texas Commission on Environmental Quality) | On 21 September 2026 Gov. Greg Abbott directed the Texas Commission on Environmental Quality to halt all permits sought by data centers until ERCOT completes its audit, in a letter to TCEQ Executive Director Kelly Keel. The governor's release says that because the PUCT, ERCOT and the Texas Water Development Board need the audit information to make informed decisions, no state agency shall move forward with regulatory approvals related to data center development until it is acquired. TCEQ must report on its compliance by Monday 19 October 2026. The directive follows the 3 August 2026 order for the PUCT and ERCOT to audit all data centers in ERCOT's interconnection process and the 14 September 2026 water-use reporting directive to the TWDB. Houston Public Media reported that the August pause reached only ERCOT connections of at least 75 MW, while TCEQ permits for river water use or on-site power plants now also stop, and that ERCOT and the TWDB are surveying more than 400 data centers for the audit. The governor also said he will work with the Legislature next session to eliminate financial incentives for data centers. The San Antonio Current reported on 29 September 2026 that Samuel Short, director of TCEQ's Air Permits Division, wrote in an email to Bastrop County residents that, at the direction of Governor Abbott, TCEQ has paused the issuance of all air and water permits and authorizations related to the construction or development of infrastructure directly supporting data centers while ERCOT completes its audit, that the Pacifico Energy campus near Cedar Creek (row 823) is on hold, and that TCEQ will give the Governor's Office a full compliance update by 19 October 2026. Public Citizen's Texas office told the outlet that TCEQ has previously said it lacks authority to halt all permits for an entire industry. At a stop in Hemphill reported on 29 September 2026, Abbott said new data centers must provide their own power and that local communities should have authority to decide whether to allow them; KTRE reported that state permits for two proposed Angelina County projects, AmpZ and Hyper Data Grid, remain on hold. | n.a. | |
| Vantage Westover Hills data center campuses (Rogers Road and Omicron Drive) and VoltaGrid on-site gas plantslitigation Suit and preliminary injunction motion filed 21 September 2026; defendants' opposed motions for extension of time filed 29 September 2026; notice of intent sent July 2026 | Vantage Data Centers; VoltaGrid (power supplier) | Federal court in San Antonio | On Monday 21 September 2026 the Environmental Integrity Project, the Sierra Club and Public Citizen filed a federal Clean Air Act lawsuit in San Antonio against Vantage and VoltaGrid over two Vantage data center campuses and the co-located gas-fueled power plants VoltaGrid built and manages. The groups allege the facilities should have obtained major source permits, with best available control technology, monitoring and public participation, before construction, instead of minor source permits, in an area that fails federal smog standards. The groups sent a notice of intent to sue in July 2026. The Rogers Road facility was partly operational before the first public hearing. The case is Public Citizen, Inc. and Sierra Club, Inc. v. Vantage Data Centers Management Company, LLC, Vantage Data Centers TX11, LLC, Vantage Data Centers TX21, LLC and VoltaGrid LLC, No. 5:26-cv-06032 in the U.S. District Court for the Western District of Texas, San Antonio Division (Judge Jason K. Pulliam, referred to Magistrate Judge Elizabeth S. Chestney), filed under the Clean Air Act citizen suit provision. With the complaint the plaintiffs filed a motion for a preliminary injunction. On 29 September 2026 the Vantage entities and VoltaGrid each filed opposed motions for more time to respond to the preliminary injunction motion, and Vantage also sought more time to answer the complaint; answers had been due 14 and 15 October 2026. Policy context

## What governs a data center in Texas

Texas (statewide audit-gated pause)state

Gov. Abbott ordered PUCT and ERCOT on 3 August 2026 to audit all data centers in the interconnection process before further approvals; non-compliant projects to be denied connection; ~1,800 projects affected. On 21 September 2026 he directed TCEQ to halt all permits sought by data centers until the ERCOT audit is complete, with a TCEQ compliance update due 19 October 2026, and said no state agency shall move forward with regulatory approvals related to data center development until the audit information is acquired. SB6, signed June 20, 2025, sets a 75 MW threshold and co-location rules for pre-September 1, 2025 generation.

Texas paused grid approvals statewide pending audits of roughly 1,800 projects in the ERCOT interconnection process. Local actions include Harlingen (May 2026), San Marcos restrictive zoning (Feb 2026), a proposed Denton pause (Jun 2026), and Fort Worth and Taylor proposals; Hood County rejected a construction pause while Hill County paused rural construction for a year before rescinding under a federal suit. On 21 September 2026 the governor extended the pause to environmental permits, directing TCEQ to issue no permits sought by data center projects until the ERCOT and Texas Water Development Board audits are complete. Houston Public Media reported that the August pause had reached only ERCOT connections of 75 MW or more, leaving out smaller projects and those building their own power plants, and that the TCEQ halt covers permits such as river water use and on-site power plants. On 24 September 2026 Attorney General Ken Paxton announced an ongoing investigation of hundreds of data center developments that have not responded to the Texas Water Development Board's mandatory water use survey, with initial investigations in Harris, Montgomery, Travis, Dallas, Tarrant, Smith, Bexar, Tom Green, Potter, Randall, Lubbock, Midland, Ector, Wichita, Victoria, Brazos, Nueces and El Paso counties. Under state law, entities that fail to submit the survey lose eligibility for TWDB financial assistance and water rights permits. A TCEQ Air Permits Division email reported by the San Antonio Current on 29 September 2026 says the agency has paused all air and water permits and authorizations related to construction or development of infrastructure directly supporting data centers until the ERCOT audit is complete, and confirms the Pacifico Energy campus near Cedar Creek in Bastrop County is on hold. On 14 September 2026 ERCOT issued a State and Community Impact Request for Information (Market Notice M-B091426-01) to developers of data centers of 25 MW or more pursuing interconnection to the ERCOT system, including Batch Zero projects not yet energized, covering public financial assistance and tax benefits, grid dependency and on-site generation, water sources and consumption (developed with the Texas Water Development Board), cooling technology, noise, light and traffic, and ownership. Responses are due 12 October 2026, and ERCOT and the PUCT plan to publish a report on or before 10 December 2026.

Texas (PUCT co-location ruling and Batch Zero continuation)state

PUCT approved net metering for a 260 MW data center co-located with a roughly 265.5 MW wind farm in Hutto on 23 July 2026 (Docket 59220), conditioned on curtailing full load within 30 minutes in grid emergencies. On 20 August 2026 the PUCT approved exceptions letting ERCOT continue Batch Zero under a revised schedule; ERCOT targets a 10 December 2026 audit filing

The co-location approval covers a Crusoe-developed facility operated by Ensign, bars participation in paid demand response tied to the arrangement, and allows physical breaker disconnection if needed. Following the governor's 3 August audit directive, ERCOT said about 300 data centers of 75 MW or more are in Batch Zero, the study will miss its 9 April 2027 deadline, and operators including Skybox, Mara, Digital Realty, QTS, Compass, Montera and Hut 8 committed to the governor's standards

Texas (ERCOT Batch Zero conditional classification and first 765-kV approval)state

Batch Zero covers large-load interconnection requests in ERCOT; the 765-kV lines are part of the Permian Basin Reliability Plan

ERCOT completed a conditional classification of 362 large-load interconnection requests totaling 191.8 GW, listing 204 projects and 66.4 GW as base load eligible for Batch Zero. On 28 August 2026 the PUCT approved Oncor's applications and final routes for the state's first two 765-kV lines, from Somervell County to Howard County and from Howard County to near the Culberson-Reeves county line, projected at $14 billion as the first part of a planned $33 billion statewide expansion, over landowner opposition and calls from lawmakers to pause transmission planning; it delayed a decision on a Hill Country line.

Texas (PUCT large load interconnection standards, 16 TAC 25.194)state

Applies to large loads of 75 MW or more. Order adopting new 16 TAC 25.194 filed 18 September 2026 in Project No. 58481 (rulemaking to implement large load interconnection standards under PURA 37.0561); Texas Register acknowledgement lists an effective date of 8 October 2026. Conditions interconnection, not a moratorium

The Public Utility Commission of Texas adopted final large load interconnection standards at its 18 September 2026 open meeting. Compared with the March 2026 proposal, the final rule drops the proposed non-refundable interconnection fee of $50,000 per MW of contracted peak demand and replaces tiered study fees with a flat $100,000 study fee. Reporting from Hearst Texas says developers must post a security deposit of $50,000 per MW of requested capacity before an interconnection study begins, show site control through ownership or lease, and disclose load-ramping schedules and expected water use; if a request is withdrawn after capacity is allocated, 20% of the security is retained. Utility Dive reports the final rule lengthens the trigger for notifying ERCOT of non-utilized capacity to 24 months behind the energization schedule as a whole (from six months per milestone in the proposal), after which the utility applies the security to amounts owed and returns the balance. Utility Dive puts ERCOT's large load queue at 474 GW, about 90% data centers.

Texas (Xcel Energy large-load tariff filing at the PUCT)state

Proposed tariff for data centers and other large loads in Xcel Energy's Texas Panhandle and South Plains territory (outside ERCOT); filed 28 September 2026, pending PUCT approval; MW threshold not stated in the fetched source

On 28 September 2026 Xcel Energy submitted a large-load tariff proposal to the Public Utility Commission of Texas setting terms under which data centers and other large users would pay for the transmission, substations, interconnection upgrades and new generation needed to serve them. It would require long-term commitments, typically 15 years or more, backed by financial security if a project is delayed, scaled back or not completed, minimum monthly payments while usage ramps, and exit fees to recover project-specific infrastructure costs. Xcel said it expects to file a similar tariff with the New Mexico Public Regulation Commission soon.

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.

Open the scarcity tracker →

Have a specific address? Site Intelligence reads all seven references against one location, county, utility and grid operator included, and cites every finding.
