| Project Lightning data center, Wildwood Commerce Park (Carroll County rejects agreement amendment)delayed Amendment rejected Monday 5 October 2026; single outlet | Undisclosed end user (Blue Ridge Crossroads Economic Development Authority negotiating) | Carroll County Board of Supervisors | On Monday 5 October 2026 the Carroll County Board of Supervisors voted down an amendment to the 16-year-old Wildwood Commerce Park agreement that would have shifted decision-making to the Blue Ridge Crossroads Economic Development Authority for an $11 billion data center proposal. Carroll was the only one of the three localities (with Grayson County and Galax) to reject it; Grayson's administrator had said all three must approve the change before the project moves forward. The authority now cannot negotiate with an end user without returning to the localities, and the board agreed to explore leaving the authority. | ≥$11.0B | |

| Digital Gatewaylitigation July 2, 2026 | QTS Realty Trust / Compass | Prince William County (Digital Gateway voided) | Prince William County (VA) Digital Gateway rezoning was voided by court order in August 2025. | $7.5B | |
| King George campusdelayed 2024-25 | Amazon | King George County | Delayed In late August 2026 AWS changed course on water supply for its planned King George data center campus at the 869-acre Birchwood Drive tech campus after its application to renew a groundwater permit for up to 6.4 million gallons a year from the Potomac aquifer drew opposition from state Sen. Richard Stuart and followed a DEQ report warning of declining groundwater east of Interstate 95. Part of the project remains tied up in court proceedings | $6.0B | |
| Gigaland Fauquier County (Gigaland)withdrawn July 16, 2026 | Gigaland | Fauquier County (Gigaland) | GigaLand withdrew its original datacenter application in Fauquier County, Virginia, after significant community opposition, but resubmitted a scaled-down proposal in early 2026, reduced by 55% to 998,000 sq ft and 600 | $3.1B | |
| Midlothian/Powhatandelayed 2024-25 | Province Group | Powhatan County | Delayed | $3.0B | |
| Google Botetourt County campuslitigation Nov 5 2025 | Google | Botetourt County | Western Virginia Water Authority stated it will not supply the 10-million-gallons/day Google sought; a FOIA lawsuit forced disclosure of secret water-use contracts (judge ordered release Nov 5, 2025), and the Water Authority is appealing to the Virginia Court of Appeals while a related water pipeline permit split the Planning Commission in August 2026. Botetourt County issued a land disturbance permit for the 312-acre Google site in the Botetourt Center at Greenfield, reported 30 August 2026, with night construction noise limits; DEQ environmental permits remain under review. In July 2026 Google announced air cooling for the first building | $1.0B | |
| Roxbury Technology Parkcancelled August 1, 2025 | Diode Ventures | Charles City County | Kansas-based Diode Ventures withdrew its $1B rezoning application for the 515-acre Roxbury Technology Park in Charles City County on August 18, 2025, after 8 months of resident organizing. | $1.0B | |

| 1500 Gatewayrejected Dec 11 2025 | n.a. | Fredericksburg | Rejected 7-0 | n.a. | |
| AWS third Louisa County data center campus (Northeast Creek Reservoir)withdrawn Withdrawal reported 25 July 2025; single outlet | Amazon Web Services | Louisa County | Amazon Web Services withdrew its request to build a third data center campus in Louisa County in July 2025, with its lawyer writing that the company had heard the community and was reevaluating the project. Residents had objected at a late June 2025 town hall over noise, traffic, water use and energy bills, and the Board of Supervisors chairman had said he would vote no. | n.a. | |
| Amazon Louisa County second data center campus nuisance lawsuitlitigation Suit filed August 2025; ruling allowing the claim reported 31 July 2026; hearing scheduled 19 August 2026 | Amazon | U.S. District Court for the Western District of Virginia (Charlottesville) | A judge allowed a private nuisance claim by neighboring homeowner Austin Newsom against Amazon to proceed. Newsom sued in August 2025, alleging construction of Amazon's second Louisa County data center has cracked his foundation, turned his well water brown, disrupted drainage and reduced his property value. A preliminary hearing was scheduled for 19 August 2026. The case is in federal court: U.S. District Judge Jasmine H. Yoon allowed the private nuisance claim to proceed but dismissed the separate claim for injunctive relief, and a preliminary hearing was set for 19 August 2026 according to U.S. District Court for the Western District of Virginia records. | n.a. | |
| Amazon data center campus on former GWU Virginia Science and Technology Campus (Bridgefield Tech Center)other Zoning administrator statement to supervisors 6 October 2026 (advisory opinion 30 July 2026); application still under staff review; single outlet | Amazon Data Services | Loudoun County | Amazon filed a by-right data center application for the former George Washington University campus, which falls under the 1972 zoning ordinance through the Route 28 Tax District. On 6 October 2026 Loudoun Zoning Administrator Teresa Miller told supervisors that, under her 30 July 2026 advisory opinion, a data center is not a permitted use of the property and Amazon must obtain Board of Supervisors approval; staff will say so in comments on the application. Covenants restrict three of the 10 parcels to higher education use, the tax district expires 5 December 2026, and a pending resolution of intent to amend the zoning would make approval very difficult, per the county attorney. | n.a. | |
| Ashtondelayed 2024-25; dollar value n.a. | Amazon | Manassas | Delayed | n.a. | |
| Balico Pittsylvania Countycancelled April 1, 2025 | Balico | Pittsylvania County | The Pittsylvania County Board of Supervisors voted to deny a massive 2,200-acre datacenter campus proposal that would have included 84 datacenter buildings and a 3,500MW natural gas power plant. | n.a. | |
| Bristow Campus (NVA02 expansion)denied Deferred November 2024 to June 2025; denied 9 September 2025 | STACK Infrastructure | Prince William County | STACK Infrastructure sought to rezone 58 acres of agricultural land near Nokesville Road for a campus outside the county's Data Center Opportunity Zone. The Board of County Supervisors hearing was deferred several times starting in November 2024, most recently 24 June 2025. On 9 September 2025 the board voted 4-2 to deny the rezoning. | n.a. | |
| Cabin Field Road data center sitedenied Denied 7 October 2025; petition hearing 20 January 2026 (outcome unconfirmed) | MESH Capital LLC | Campbell County | On 7 October 2025 the Campbell County Board of Supervisors voted 5-2 to deny MESH Capital's request to remove a protective proffered site plan from 2000 on about 57 acres, and a motion to require special use permits for data centers failed 6-1. MESH then submitted three scaled-back concept plans that county staff found consistent with the original proffer, keeping a by-right path open. An adjacent owner petitioned for review on 25 November 2025, and the board scheduled a hearing for 20 January 2026. The outcome of that hearing was not confirmed in the reporting reviewed. | n.a. | |
| Chesapeake rezoningdenied May 2025 | n.a. | Chesapeake | Recommended denied 6-1 | n.a. | |
| Chesterfield County halt on new data center approvalsother Policy announced at a Wednesday press conference, reported 27 August 2026 | n.a. | Chesterfield County | Chesterfield Deputy County Administrator Jesse Smith said at a press conference that the county has enough data centers and the Board of Supervisors will not approve zoning requests for new projects beyond those already approved. Developers can still apply through the conditional use permit process, but staff would not recommend it because the board has indicated it has no appetite for more. Google's planned and under-construction campuses in the county continue. | n.a. | |
| Convergent Technology Parkwithdrawn Withdrawn 27 August 2026; reported 2 September 2026 | Jeffrey Price (Convergent Technology Park) | Fauquier County | Convergent Technology Park withdrew its application to rezone more than 100 acres south of Remington for a six-building data center campus. Developer Jeffrey Price told the county he will pursue housing on the property instead. The withdrawal came just over a week after the nearby Gigaland project also withdrew, leaving Remington Technology Park as the only one of three proposed Remington-area data center projects still moving forward. | n.a. | |
| Dulles South Innovation Center (Dulles Cloud South)denied Denied 7 July 2026 | Sanders Lage Assemblage I LLC | Prince William County | The Prince William Board of County Supervisors voted 8-0 on 7 July 2026 to deny the rezoning for roughly 43 million sq ft of data centers on about 1,940 acres along Sanders Lane near the Loudoun County line. The site lies outside the county's Data Center Opportunity Zone Overlay District. Supervisors cited conflict with the 2040 Comprehensive Plan, emissions from roughly 6,000 planned diesel generators, and Occoquan watershed protection. The vote followed the collapse of the Prince William Digital Gateway. | n.a. | |
| Fairfax County data center moratoriummoratorium Enacted September 2024 | n.a. | Fairfax County | Fairfax County, Virginia, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated September 2024. Not a pause, a standing zoning ordinance amendment, adopted 10 September 2024 and effective Sep 11, that requires Board of Supervisors special-exception approval for nearly all new data centers (by-right only in I-5/I-6 industrial districts), 200-ft setbacks from residential lot lines (300 ft for backup generators), a one-mile buffer from Metro stations, full enclosure or screening of mechanical equipment, and pre- and post-construction noise studies. A companion substation amendment adopted 9 December 2025 (unanimous) adds 100-ft residential setbacks, 12-ft solid walls, a 50-ft planted buffer and a 55 dBA nighttime noise limit, but leaves substations by-right in industrial zones, which is why the Plaza 500 (Lincolnia) fight runs through a 2232 public-facility review rather than a rezoning. Applications pending on 11 September 2024 were grandfathered. The measure has no end date by design and covers rezoning requests. | n.a. | |
| Front Royal data center moratoriummoratorium Enacted July 2026 | n.a. | Front Royal | Front Royal, Virginia, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated July 2026. 90-day moratorium on land-use applications for data centers, 6-0. Planning Commission drafting language to prohibit data centers in every town zoning district. The measure runs to 4 October 2026. | n.a. | |
| Gigaland data center campuswithdrawn First withdrawal 29 August 2025; second August 2026 | GigaLand LLC | Fauquier County | Gigaland sought to rezone land near Remington for a large data center campus. After the Planning Commission recommended denial, the developer withdrew in August 2025 and a scheduled September 2025 Board of Supervisors hearing was canceled. A scaled-down resubmission followed, and in August 2026 the developers withdrew their comprehensive plan amendment, rezoning and special exception requests again, acknowledging they lacked the votes. The applicant could return as soon as January 2027. | n.a. | |
| Hunting Hawk Technology Centercancelled January 28, 2026 | HHHunt | Hanover County | In Hanover County, Virginia, HHHunt's proposed Hunting Hawk Technology Park, a 10-building, 400-acre data center campus near the Wyndham community capable of supporting up to 900 MW, was rejected by Hanover's Planning | n.a. | |
| Iron Horse data center campus (Hanover-Ashland line)delayed Deferred mid-June 2026; Planning Commission recommended approval 5-2 on a Thursday, reported 20 August 2026; supervisors' vote pending | WestDulles Properties | Hanover County Planning Commission | The Hanover Planning Commission unanimously deferred consideration of the revised Iron Horse data center rezoning in mid-June 2026. On 20 August 2026 the commission voted 5-2 to recommend approval of a scaled-down version with fewer homes, lower buildings and more open space, sending it to the Board of Supervisors, which rejected an earlier version in 2024. The final decision rests with supervisors. | n.a. | |
| Loudoun County 12-month pause on legislative data center applicationsother Direction to draft approved 7-1-1 on 15 September 2026; staff to return with the resolution and board to make a final decision on 13 October 2026 | n.a. | Loudoun County | The Loudoun County Board of Supervisors voted 7-1-1 on 15 September 2026 directing staff to draft a resolution pausing data center applications for 12 months while new regulations are written. Supervisor Kristen Umstattd voted against and Supervisor Caleb Kershner abstained. As described, each application would be paused for one year from its submission date. Board Chair Phyllis Randall said the measure is not a ban or a moratorium. A separate vote is still required to adopt the resolution. Loudoun Now reported that staff will bring the resolution back in October 2026 for a final board decision, that County Attorney Leo Rogers advised a moratorium is not legal in Virginia so the measure relies on the 12-month review deadlines for legislative applications, that by-right applications (an estimated 18.2 million sq ft of data center space) are not affected, and that new data center regulations are expected to be completed in July 2027 | n.a. | |
| Mountain Road Technology Parkdenied Denied 28 May 2026 | Tract | Hanover County | The Hanover County Board of Supervisors voted 4-3 on 28 May 2026 to deny Tract's rezoning for a data center park on nearly 430 acres. Opponents cited estimated water use of 600,000 gallons per day, described as about 90 percent of the zone's water supply, along with power demand, noise and rural character. Tract had offered a $15 million commitment toward county water infrastructure. | n.a. | |
| NOVEC Prince William County (Diamond Hill substation)denied March 11, 2026 | NOVEC | Prince William County (Diamond Hill substation) | Prince William County, Virginia, Planning Commission voted 5-3 on March 11, 2026 to deny the Diamond Hill substation, a proposed 300 MW electric utility substation with a collocated Dominion Energy switching station | n.a. | |
| New Kent Technology Overlay Districtrejected Overlay ended 14 July 2026 | n.a. (county-initiated overlay) | New Kent County | New Kent County staff spent more than a year drafting a 1,800-acre Technology Overlay District along the Route 33 corridor where data center applications could be approved without public hearings. On 14 July 2026 the Board of Supervisors ended the overlay effort after widespread public opposition. The same night the board voted 3-2 to rezone about 343 acres for The Curtis Group's Eltham Business Park, described as commercial and light-industrial use. Staff were directed to draft a data center ordinance with strict performance standards. | n.a. | |
| Oaklawn data center rezoninglitigation Denied January 2025; suit February 2025 | Oaklawn, LLC | Town of Leesburg | Leesburg Town Council denied Oaklawn LLC's application in late January 2025, which sought up to 450,000 sq ft of data center use alongside affordable housing units. In February 2025 Oaklawn LLC and Oaklawn Development Partners sued the town in Loudoun County Circuit Court seeking a declaratory judgment. The town attorney said the council followed the zoning ordinance standards. A trial outcome has not been confirmed in the reporting reviewed. | n.a. | |
| Penzance Development / 1500 Gateway LLC Fredericksburgcancelled December 11, 2025 | Penzance Development / 1500 Gateway LLC | Fredericksburg | Penzance Development / 1500 Gateway LLC proposed a 600 MW data center on 84 acres in Fredericksburg, Virginia. | n.a. | |
| Potomac Creek Campus data centerdelayed Deferred 7 July 2026; time extension to 31 October 2026 | n.a. | Stafford County Board of Supervisors | The Stafford County Board of Supervisors voted 4-3 to defer rezoning and conditional use permit applications for the Potomac Creek Campus data center project pending an archaeological investigation of a family cemetery on the site. The deferral includes a time extension to 31 October 2026. The board directed that the report be shared with the Historical Commission, Planning Commission and supervisors. | n.a. | |
| Prince William County data center overlay and by-right overhaulother Planning Commission recommendation 9 September 2026; Board of County Supervisors adopted 8-0 on 22 September 2026 with a 90-day grace period; setback hearing targeted for November 2026 (Planning Commission) and January 2027 (Board) | n.a. | Prince William County | The Prince William County Planning Commission recommended on 9 September 2026 that the Board of Supervisors narrow the data center overlay and end by-right development, with a 120-day eligibility window and a 500-foot separation from homes and schools for qualifying projects. The Board was scheduled to consider the restrictions on 22 September 2026. The Prince William Times reported the Planning Commission vote on 9 September 2026 was 5-3, after commissioners deadlocked on motions for a 180-day window and for no window. On 22 September 2026 the Board of County Supervisors voted 8-0 to approve the zoning text amendment ending by-right data center development countywide, with a 90-day grace period rather than the 120 days the Planning Commission recommended; a substitute motion for no grace period failed 3-5. WUSA9 reported the Data Center Opportunity Zone Overlay District shrinks by roughly 62 percent, from about 9,700 acres to about 3,500 acres, and new data centers outside the remaining overlay will generally need a special use permit. Data centers already built, under construction or holding a site plan that has passed the quality control threshold are not affected. The 500-foot setback was not taken up; county staff are targeting a Planning Commission hearing in November and a Board hearing in January. The same night the Board unanimously denied Dominion Energy's Vint Hill gas-insulated switching station. | n.a. | |
| Project Industry data center (Wellington Road)delayed Deferred 1 September 2026; reported 10 September 2026 | Industrial Park Court, LLC | Prince William County Board of County Supervisors | The Prince William Board of County Supervisors voted to defer the Project Industry rezoning and proffer amendment, which would raise allowed building height to 85 feet and permit a substation up to 110 feet. The Planning Commission had deadlocked 3-3 on 20 May 2026 on a motion to recommend denial, which county staff treated as no action. The Coalition to Protect Prince William County said the deferral showed the applicant lacked the votes. | n.a. | |
| Remington Innovation Campus rezoningwithdrawn Withdrawn 17 September 2026 | SDC Capital Partners (Ron Meyer); applicants include Supervisor Daron Culbertson | Fauquier County | The applicants withdrew the rezoning application on Thursday 17 September 2026, hours before a Planning Commission work session; Ron Meyer of SDC Capital Partners emailed the withdrawal at 7:16 a.m. and the county confirmed it at 7:21 a.m. Lee District Supervisor Daron Culbertson is among the applicants. The 900 MW figure comes from the Piedmont Environmental Council, an advocacy group that recommended denial, and is not stated by the applicant. | n.a. | |
| Roxbury Technology Park (Diode Ventures)withdrawn Withdrawal notified 18 August 2025; reported 21 to 22 August 2025 | Diode Ventures | Charles City County | Kansas-based Diode Ventures withdrew its application to rezone about 515 acres for the Roxbury Technology Park data center campus, notifying the Board of Supervisors on 18 August 2025, after months of resident opposition. The Planning Commission had recommended approval in May 2025 and supervisors deferred a decision in June 2025. Diode said it has no plans to resubmit on the site or elsewhere in the county. | n.a. | |
| Spotsylvania County data center moratoriummoratorium Enacted August 2026 | n.a. | Spotsylvania County | Spotsylvania County, Virginia, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated August 2026. Resolution adopted 4-2 (Mullins and Frazier opposed) backing Sen. Sturtevant's call for the governor to 'issue a statewide moratorium on data centers to determine whether development should be permitted and, if so, under what conditions'. Sits on two standing local rules: a February 2026 vote requiring a special use permit for every data center, ending by-right siting even on industrial land, and an 25 August 2026 comprehensive plan amendment (3-2) capping data centers at 45% of the county's industrial-zoned land, with two supervisors voting no because they wanted a lower cap. The county had earlier welcomed some $35B in data center investment. The measure has no end date by design. | n.a. | |
| Spring Valley Technology Parkother PC denial recommendation 23 July 2026; Board decision pending as of September 2026 | Active Infrastructure | Loudoun County | The Loudoun County Planning Commission voted 5-0 on 23 July 2026 to recommend denial of Active Infrastructure's rezoning (LEGI-2024-0074) for a 780 MW, 3.54 million sq ft campus on 325 acres near Beaverdam Reservoir. County staff had also recommended denial, calling the rezoning a fundamental departure from planned land uses. More than 500 residents attended the hearing. As of September 2026 the application awaits a final Board of Supervisors decision. | n.a. | |
| Stafford County data center moratoriummoratorium Enacted October 2025 | n.a. | Stafford County | Stafford County, Virginia, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated October 2025. Standing ordinance, not a pause. Phase 2 data center rules (Ordinance O25-29 and Comprehensive Plan amendment R25-208, adopted 21 October 2025; O25-29(R) on 2 December 2025 grandfathered five approved projects, Stafford Technology Campus, Potomac Church Tech Center, Centreport Gateway/Pemberton, Vantage VA-4 and Cranes Corner, 31 buildings and 8.7M sq ft) on top of the October 2023 Phase 1 rules: by-right only in M-2 and the ICTP overlay, 100/200-ft setbacks from non-commercial zoning (a 500-ft residential setback was recommended), sound mitigation with post-occupancy noise checks at 90 days and annually, 30% open space outside the urban service area. The county reports 11 applications still under review and none filed since September 2025. On 1 September 2026 the board directed staff to draft letters asking Gov. Spanberger for a special session on data center rules and, failing quick legislation, a temporary pause on new large-scale approvals; Chair Diggs calls the ordinance 'the strictest in Virginia'. The measure has no end date by design. | n.a. | |
| Virginia Beach 12-month data center application moratoriummoratorium Approved unanimously Tuesday 18 August 2026; 12 months or until an ordinance is adopted | n.a. | Virginia Beach City Council | The Virginia Beach City Council voted unanimously to pause new data center applications for at least a year or until an ordinance regulating data centers is adopted. Council members said they want to ban large-scale data centers but setting the threshold is a challenge, and a planning commissioner had urged closing the by-right path for data centers on industrial parcels. The same day neighboring Chesapeake ended by-right data center development, requiring council approval. | n.a. | |
| Virginia Technology Park (Clear Brook)other Planning Commission denial recommendation 3 June 2026; Board of Supervisors hearing not set as of 3 September 2026 | Equus Capital Partners Ltd. | Frederick County | The Frederick County Planning Commission voted 10-0 on 3 June 2026 to recommend denial of the Virginia Technology Park rezoning. Commissioners cited insufficient enforceable proffers, and residents raised water use of up to 120,000 gallons per day and noise concerns. The Board of Supervisors was scheduled to consider the case on 8 July 2026; that outcome was not confirmed in fetched sources. | n.a. | |
| Wilderness Crossing mixed-use and data center rezoninglitigation Rezoning approved 2023; suit filed 2023; motion to dismiss partially denied September 2025; board resolution on the zoning district defect 29 September 2026 | n.a. | Orange County Board of Supervisors; Orange County Circuit Court | The Orange County Board of Supervisors approved the Wilderness Crossing rezoning in 2023, and the American Battlefield Trust, Central Virginia Battlefield Trust, Friends of Wilderness Battlefield and nearby homeowners sued the county that year. The Orange County Circuit Court partially denied the county's motion to dismiss in September 2025, letting parts of the case proceed. On Tuesday 29 September 2026 the board voted 5-0 to adopt a resolution acknowledging that ZA 18-05, the 2018 text amendment creating the Planned Development-Mixed Use district that the project relies on, was not initiated as Virginia Code 15.2-2286(A)(7) requires; the county said the resolution does not repeal the district or decide the validity of later land use actions, which remain before the court. | n.a. | |
| Winchester Gateway data center campusother Planning Commission denial recommendation on a Wednesday, reported 3 September 2026; Board of Supervisors hearing scheduled 23 September 2026 | Winchester Gateway LLC | Frederick County Planning Commission | The Frederick County Planning Commission unanimously recommended denial of a conditional use permit for the Winchester Gateway data center campus, citing unresolved transmission needs, undisclosed power demand, building height and viewshed concerns for the Kernstown Civil War battlefield. The county's Historic Resources Advisory Board had recommended denial in April 2026. The same night the commission recommended an ordinance amendment removing data centers as a permitted or conditional use in all county zoning districts, which would not apply to pending applications. The Board of Supervisors set public hearings for 23 September 2026. | n.a. | |

Policy context

## What governs a data center in Virginia

Loudoun Countycounty

Eliminated by-right data center development 7-2 on March 18, 2025, requiring special exceptions. On 2 September 2026 the Board of Supervisors took up a proposal to revoke the 2025 grandfathering resolution covering approximately 22 in-development projects, and amended it to first obtain a county attorney legal opinion.

Loudoun County, the largest data center market, ended by-right development and now requires special exceptions for data center projects. Supervisors Juli Briskman and Laura TeKrony introduced a measure to eliminate the grandfathered exemptions, which would force roughly 22 in-development data center projects that were exempted when the county ended by-right development to go through the newly required public hearings. The board did not vote on the measure. It amended the resolution to secure a legal opinion from the county attorney and compile details on the exempted projects first, with Board Chair Phyllis Randall calling for the legal opinion to be shared publicly at an October 6 meeting while the official memo remains confidential. No project has been blocked by this action and no dollar or megawatt figure is attached to it. Separately, Virginia DEQ proposed a $2.5 million consent order, signed by Microsoft on 3 September 2026 and open for comment to 14 October 2026, over 62 generators run for seven days at 19515 Compass Creek Parkway in Leesburg during the summer 2025 Cochran Mill substation outage, the largest civil penalty DEQ has assessed a data center.

Prince William Countycounty

Initiated ZTA DPA2026-00006 on March 3, 2026 to curtail by-right development.

Prince William County began a zoning text amendment to curtail by-right data center development following the Prince William Digital Gateway collapse.

Warrentoncity

Permanent data center ban adopted July 2025, following a court-ordered one-year stall of an Amazon site.

After a court-ordered one-year stall on Amazon's 42-acre, 220,000 sq ft, $39M site, Warrenton adopted a permanent ban in July 2025.

Virginia (statewide)state

Statewide moratorium bill HB 1515 failed; Governor Spanberger declined a statewide moratorium in August 2026, citing the $67B Dominion/NextEra merger. C.4 floors: 2 GW (PWDG) + 300 MW (Powhatan) + 200 MW (Chesapeake) + 50 MW (DC Blox) + 3,500 MW (Pittsylvania gas) paused/at risk; 45 GW in Dominion queue with no connection date; $47.8B+ identified; 12 projects; 23 tracked siting actions.

Dimetrics tracks 23 Virginia siting actions spanning 2023-2026, including the Warrenton ban and county-level restrictions from Fauquier to Fairfax. A statewide moratorium failed and the governor declined to impose one by order. On Thursday 1 October 2026 Gov. Abigail Spanberger released the 2026 Virginia Energy Plan, a planning document that models four pathways to net-zero by 2050 and recommends demand flexibility for data centers, including battery fleets financed by data centers in place of on-site fossil generation. The plan cites a PJM forecast of up to 68.8 GW of peak demand for Dominion Energy and Appalachian Power, and a Dominion connection queue of 25 GW with an energization date plus 75 GW without one. Many of its recommendations need legislation or State Corporation Commission action; it imposes no new requirement by itself.

Virginia (SCC order on Dominion transmission cost assignment)state

Order issued 31 July 2026 in Dominion's Rider T-1 proceeding. Mandatory contribution in aid of construction for direct-connect facilities and the substations and lines connecting them; GS-4 covers customers of at least 500 kW, and the SCC flagged possible future review of a GS-5 class for 25 MW and above

The SCC ordered Dominion Energy to directly assign certain transmission costs to large-load facilities such as data centers that require them, and said a coming docket may weigh extending direct assignment to more upstream transmission costs. Dominion sought about $1.5 billion through Rider T-1, and the SCC cut the proposed residential monthly increase from $2.90 to $0.94. . The SCC's 31 July 2026 decision directs Dominion to file, within 90 days in a new docket, an amended line extension policy requiring a mandatory contribution in aid of construction for defined transmission facilities such as direct-connect facilities. Microsoft filed a notice of appeal with the Supreme Court of Virginia on 28 August 2026; a spokesperson said the company has not appealed the decision itself and filed the notice to preserve its right to challenge how the decision is put into rates. Utility Dive said Microsoft has until November to formally appeal.

Virginia (Executive Order 22)state

Binding now for state executive-branch agencies; legislative proposals for the 2027 General Assembly would require local approval above 25 MW. Not a moratorium

Governor Abigail Spanberger signed Executive Order 22 on 18 September 2026. It bars state executive-branch agencies and employees from entering or enforcing NDAs on data center projects, directs a local planning and community engagement toolkit, faster noise regulation and a review of backup generators, sets energy-affordability and workforce directives, and creates a three-member AI Task Force. Proposed for the 2027 General Assembly: ending by-right approval with local approval above 25 MW, a statewide NDA ban for commercial projects, ending state site-development subsidies and fast-track permitting for large data centers, fairer allocation of transmission, generation and PJM interconnection costs, efficiency, water and land-use standards, limits on on-site gas generation, and local hiring. The order does not end the sales tax exemption

Figures beside each state are named sites and blocked, delayed or restricted projects.

Part of the [North American Data Center Capital Atlas](https://savrn.com/data-center-capital-atlas), refreshed every Tuesday, Thursday and Saturday. Announced commitments overlap one another and overlap reported capital expenditure, so this page shows disclosed floors and never adds them into a single deployment figure. Informational, not investment or legal advice.

The SAVRN reference set

## Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Delay Watchlist

Project-level slippage: named projects, jurisdictional actions, utility and federal dockets, SEC disclosures, and the interconnection queue.

[Open the watchlist →](https://savrn.com/data-center-delay-tracker)

Moratorium Tracker

The policy layer: every state measure and local moratorium mapped and cited, with one page per state.

Open the tracker →

Water Tracker

Every federal, state, local and interstate water measure that touches a data center, plus a fifty-state water ledger.

Open the water tracker →

Grid Operator Watchlist

ERCOT, PJM, MISO, CAISO, SPP, NYISO, ISO-NE and FERC: the large-load rules, filings and queue positions that decide whether a site can energize.

Open the watchlist →

Permits and Power Development

Data center and substation permits, large loads in the interconnection queues, and the power plants planned to serve them, refreshed hourly from public records.

Open the permits tracker →

SAVRN Scarcity Tracker

Eleven primary-sourced indicators of AI infrastructure scarcity, one composite index, read against the token index, SAVRN's own cost basis and the frontier ceiling.
