Harrington conditional-use ordinance rejection
rejected Rejected 17 August 2026
n.a. City of Harrington, Kent County
City council members voted unanimously on 17 August 2026 to reject an ordinance that would have added data centers as a conditional use in the city's manufacturing zone. Without the amendment, data centers cannot be built in Harrington, including a proposed 24 MW facility at the former Harrington Logistics building. Residents cited water, sewer and electrical infrastructure capacity and noise. Reporting notes the developer had offered the city $1 million.

New Castle County data center moratorium
moratorium Enacted March 2026
n.a. New Castle County
New Castle County, Delaware, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated March 2026. Council voted 12-0 for zoning regulations: 1,000-foot residential buffer (500 ft with noise study), closed-loop cooling required, energy-efficient backup generators, decommissioning funds; existing projects exempt. The measure has no end date by design.

Project Washington data center (Delaware City)
withdrawn Appeal withdrawn early July 2026; reported 28 August 2026
Starwood Digital Ventures State of Delaware (Coastal Zone Act)
Delaware Environmental Secretary Greg Patterson ruled the Project Washington plans would violate the Coastal Zone Act, and a state board upheld the decision. Starwood appealed to Delaware Superior Court but voluntarily withdrew the appeal in early July 2026, two days after the legislature passed stricter data center bills. With no remaining challenge, the project cannot proceed under its current design. A Starwood spokesman said the company is still seeking a pathway forward.

White Clay Center data center campus (Newark)
paused Pause agreed by email 10 June 2026; reported 2 July 2026. Reported by Spotlight Delaware
Shelbourne New Castle County
New Castle County Councilman Tim Sheldon said he brokered a nonbinding handshake deal under which developer Shelbourne agreed to pause the data center plan and consider other uses for the site. An email dated 10 June 2026 from the developer's attorney agreed to the pause, conditioned on county approval of an exploratory plan that would grandfather the land under prior zoning rules. The developer retains the legal right to build a data center.

What governs a data center in Delaware

Delaware (data center ratepayer and clean energy laws)state
Applies to hyperscale data centers in Delmarva Power territory; also bars data centers from job-creation tax credits
Governor Matt Meyer signed a package on 26 August 2026 requiring Delmarva Power to create a separate, higher rate for hyperscale data centers, assigning them transmission, distribution and capacity costs where possible, requiring load reduction at peak, and requiring data centers to generate their own renewable-portfolio-eligible power over a 10-year period with cleaner backup power.

The policy layer for Delaware lives in three companion references: the Delaware Data Center Moratorium Tracker for every state measure and local moratorium on record, the Water Tracker for the water rules that touch a site, and the Grid Operator Watchlist for the large-load rules of the RTO or utility that decides whether it can energize.

The SAVRN reference set

Seven references, one system

Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.

Have a specific address? Site Intelligence reads all seven references against one location, county, utility and grid operator included, and cites every finding.
