Beltline Energy data center (Highway O site) approved after delay City rezoning request tabled 25 February 2026; county rezoning approved 15 September 2026 |
Beltline Energy | City of Pacific Planning and Zoning Commission | Beltline Energy pulled its rezoning request for a proposed $16 billion data center from the agenda of a special Pacific Planning and Zoning Commission meeting on 25 February 2026, minutes into the meeting, citing an inability to finalize a funding agreement. Residents who had filled a high school auditorium to speak against the project were not able to address the commission. The city later adopted a 12-month data center moratorium (separate row). First Alert 4 describes the city request as tabled. The Franklin County Commission approved rezoning for the same Highway O site, the Meramec Valley Technology Park, on 15 September 2026. |

CRG Festus campus litigation litigation Suit filed 8 April 2026 |
CRG (Clayco) | City of Festus, Jefferson County | Wake Up Jeffco LLC, Sherman Doyle, Vernon Valish, Sharon Valish and Rozilyn Daniels filed suit on 8 April 2026 in St. Louis County Circuit Court against the City of Festus and CRG Acquisition LLC, seeking to stop the project by invalidating the city's rezoning decisions and its development agreement. The suit followed the council's 6-2 approval of the development agreement on 30 March 2026. Motions to dismiss had been filed and answered as of mid-June 2026, and as of 12 June 2026 no construction plans or permit requests had been submitted. The council separately voted 5-2 on 24 August 2026 to annex three additional parcels for the project. On 24 August 2026 the Festus City Council voted 5-2 to annex three more parcels totaling 6.55 acres along Hwy. 67 for the CRG data center project, which the Leader describes as a hyperscale data center on 361 acres that CRG, the data center development arm of Clayco, estimates will cost US$6 billion. The council approved a development agreement with CRG Acquisition on 30 March 2026, and CRG's president hopes construction starts in November 2026. The St. Louis Post-Dispatch reports data center opponents were in Jefferson County court over whether a recall of four Festus officials should go before voters. |

TerraWatt Midtown (Armory) data center litigation Developer and opponent suits reported 29 September 2026; developer suit filed the week of 21 September 2026; single outlet |
TerraWatt | City of St. Louis | St. Louis approved the Midtown data center with a community benefit agreement that lets the city fine the developer for tax revenue and job shortfalls and revoke permits for uncorrected noncompliance. TerraWatt's chief executive then sued the city, arguing the requirements exceed its powers and would make construction impossible, and several opponents separately sued the city to stop the development. |

Former Emerson campus technology hub and data center approved after delay Rejected May 2026 on a 3-3 vote; revived legislation introduced 10 September 2026; approved 4-3 on 22 September 2026; referendum petition launched 23 September 2026, signature drive continuing as of 2 October 2026 |
Next Revolution Technologies | City of Ferguson | The Ferguson City Council rejected the tax incentive package in May 2026 on a 3-3 vote with one abstention. On 10 September 2026 council members Nick Kasoff and LaMika Covington introduced legislation reviving it, with a final vote expected later in September 2026. The revived plan keeps a 75 percent abatement for the first ten years and adds a $7.5 million commitment to the Ferguson Neighborhood Improvement Program over ten years, $250,000 for an environmental mitigation fund and $700,000 for community impact mitigation and emergency services. Opposition continued from residents, the St. Louis County NAACP and the Ferguson-Florissant School District; the mayor said he would vote against the plan. On 22 September 2026 the Ferguson City Council approved the revived redevelopment agreement 4-3. Residents launched a petition drive on 23 September 2026 to force a referendum on the agreement, and opponents said they are exploring legal options. KSDK reported on 2 October 2026 that opponents are gathering signatures for a referendum petition that would force the council to repeal the approving ordinance or put it to a public vote, with a signature deadline later in October 2026, and that a recall effort is also underway. KSDK describes the project (Project Butterfly, developer Jim Onder of SSL Investments LLC, 217 acres at 8000 West Florissant Avenue) as a Chapter 100 package that could scale to $22 billion over time, with an initial investment above $175 million. |

Benton County data center moratorium moratorium Signed 10 August 2026; six months to 10 February 2027; enforcement enjoined 6 October 2026 |
n.a. | Benton County Commission | The Benton County, Missouri, Commission signed a six-month data center moratorium on 10 August 2026, running to 10 February 2027. Developer Trent Overhue, through NSI6 LLC, challenged it in court; he testified he chose the county because it has no planning and zoning. A temporary restraining order was granted on 8 September 2026, Overhue closed on a roughly 12-acre site on old Highway 65 on 9 September and began clearing it, and on 21 September 2026 the judge extended the restraining order while considering a preliminary injunction (see the separate litigation row). A preliminary injunction granted on 6 October 2026 in the NSI 6 lawsuit (row 767) bars the county from enforcing the moratorium until a final judgment. |

Benton County data center moratorium lawsuit (NSI6 LLC) litigation TRO granted 8 September 2026; extended 21 September 2026; preliminary injunction granted 6 October 2026 |
NSI6 LLC (Trent Overhue) | Benton County Circuit Court | Developer Trent Overhue's NSI6 LLC sued the Benton County, Missouri, commissioners over the county's six-month data center moratorium signed 10 August 2026. A temporary restraining order was granted on 8 September 2026, and Overhue closed on the roughly 12-acre site on 9 September and began clearing land. At a hearing on Monday 21 September 2026 on a preliminary injunction to keep the county from enforcing the moratorium, the judge extended the temporary restraining order and urged caution about construction until a final decision. The county argues the moratorium is valid because the company was not formed until 13 August 2026, three days after the moratorium. On Tuesday 6 October 2026 Senior Judge Jacqueline Cook granted a preliminary injunction barring the Benton County Commission from enforcing the moratorium until final judgment, finding the ordinance relied on no findings or data that data centers pose a health risk and that NSI 6 has a sufficient probability of success. NSI 6 plans a data center on a 12-acre site at U.S. Route 65 and Dam Access Road in Warsaw. No further hearings were scheduled. |

Nebius Independence AI factory (Bly Road) litigation Lawsuit filed 13 August 2026; TRO hearing set for 22 October 2026 |
Nebius Group (Missouri ADC Holdings LLC) | City of Independence | Four residents affiliated with the Independence Guard Alliance filed a lawsuit on 13 August 2026 asking a Jackson County judge to halt construction of the Nebius data center on Bly Road. The suit names Missouri ADC Holdings LLC and challenges City Council actions before its 2 March 2026 vote approving more than $6 billion in tax breaks and other funding mechanisms. Plaintiffs allege violations of the Independence City Charter and the Missouri Sunshine Law. Nebius broke ground in May 2026 and construction was continuing when the suit was filed. A motion hearing on a temporary restraining order to halt construction, sought by the Independence GUARD Alliance and residents who allege permit violations, is set for Thursday 22 October 2026 in the Eastern Jackson County Courthouse. |

The order covers the construction or establishment of a data center or any supporting or ancillary facility in unincorporated areas, and the county may seek cease and desist orders for violations. The commission said the pause allows time to study the issue and to consider adopting planning or zoning. The proposed White Cloud Acres site has no announced occupant, and the developer holds an option on the land but has not bought it. |

Springfield 120-day data center administrative delay litigation Passed 29 June 2026; 120 days to 17 November 2026; developer suit filed 17 September 2026; related rezoning application withdrawn 1 October 2026 |
n.a. | City of Springfield | Springfield City Council passed a 120-day administrative delay on data center projects 8-0 on 29 June 2026 (Ordinance 28306), expiring 17 November 2026. Staff will evaluate land use compatibility, electric, water and wastewater impacts, and noise and air impacts, and hold public open houses before reporting to the Planning and Zoning Commission and council; City Manager David Cameron has indicated staff will seek an extension. On Thursday 17 September 2026 NSI A.1 LLC, affiliated with developer Trent Overhue, filed a 31-page, six-count petition in Greene County Circuit Court before Judge Nathan Taylor to invalidate the delay. The petition argues the measure is interim zoning adopted without the required public hearing and 15 days' published notice, that it was filed as a resolution in conflict with the City Charter, and that the city violated the Sunshine Law. Overhue's pre-development application proposes a high-performance computing facility in the basement of a former medical office building at 2900 S. National Ave.; an electric service application to City Utilities listed anticipated demand of 9.9 MW and was not processed because of the delay. On Thursday 1 October 2026 the rezoning application for 2900 S. National Ave. (to C-MX2 for a veterinary clinic, with no mention of a data center), which had been postponed to the 15 October Planning and Zoning Commission meeting, was withdrawn. Overhue said he had only authorized a conditional allowance for a veterinary tenant while pursuing his original basement data center plan. The News-Leader reports the City Council is likely to extend the pause beyond mid-November; Overhue's suit against it remains pending. |

The ordinance bars approval of new or expanded data centers larger than 100,000 square feet or with electricity demand above 5 MW while the county studies health, water, energy bill and quality-of-life impacts. The county followed the City of St. Charles, which adopted a one-year moratorium and then a data center ban in May 2026. One councilman argued for a longer or permanent pause. |

Western Newspaper Union building data center tower denied Denied by the Plan Commission 5 August 2026; related development ordinance listed as pending until 13 October 2026 (reported 7 October 2026) |
Revitalization Unlimited | City of Kansas City | Miami-based Revitalization Unlimited proposed a 384-foot, 20-story data center on the historic Western Newspaper Union building in Quality Hill. The Kansas City Plan Commission voted 6-0 to deny it on 5 August 2026. The developer could ask City Council to override, but Mayor Quinton Lucas said reversal was highly unlikely. The developer had placed a preservation easement on the building on December 31 before proposing its demolition in March 2026. TechRadar Pro reported on 7 October 2026, via Data Center Knowledge, that the tower, designed by Skidmore, Owings and Merrill, would provide 24 MW of IT capacity on about 0.23 acres, with only two of its 20 floors holding servers, at a total development cost of $183 million (about $167 million of hard costs), and would rely on 30 MW of Bloom fuel cells for primary power. A related development ordinance was listed as pending at the City Council until 13 October 2026. |

Every state, one page each
Figures beside each state are named sites and blocked, delayed or restricted projects.
Seven references, one system
Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.
