PAX-1 data center (Middlesex Township) litigation Arguments heard 18 September 2026; stay denied 22 September 2026; mandatory stay refused 5 October 2026; discretionary stay hearing 13 November 2026 |
Carlisle Development Partners | Cumberland County Court of Common Pleas | Residents led by Kyler Gerber appealed the township's approval. Judge Matthew Smith heard arguments on Friday 18 September 2026 and is reviewing a 21,000-page record, with no ruling timeline announced. The project is under construction. On Tuesday 22 September 2026 Judge Smith denied the appellants' request to halt work while their appeal of the township's 6 May preliminary land development approval proceeds, writing that it does not appear from the record that the appellants have a strong likelihood of prevailing on the merits. The case was not dismissed and the judge will continue to take argument; a separate suit challenging the 2025 zoning map change remains alive, and a DEP permit appeal is pending before the Environmental Hearing Board. PennLive reports the project at full buildout would be 16 buildings with a maximum computing power of 1.35 GW. PennLive reported on 1 October 2026 that the five neighboring property owners filed a new motion asking the Cumberland County court to stay construction and further plan review. They argue that state law and township ordinances require a pause while their substantive validity (spot zoning) challenge to the May 2025 data center overlay, filed with the township zoning hearing board on 13 May 2026, remains pending because the board never acted on it; in the alternative they ask for a discretionary stay. The requested stay would not apply to a PPL substation planned on the site. No court date had been set on the motion. In a ruling on Monday 5 October 2026, Cumberland County Judge Matthew Smith declined to order construction stopped, finding that a mandatory stay applies only to hearings pending before the zoning board, but scheduled a hearing for 13 November 2026 on whether to grant a discretionary stay; at the same hearing he will consider whether the challenge is a frivolous appeal under Pennsylvania law. Township supervisors gave final approval to PAX-1 in September 2026. |

DANKO Holdings Muncy Township data center litigation Appeal filed 14 August 2026; motion to quash 28 August 2026; Commonwealth Court constitutional appeal filed 25 September 2026; argument on the county appeal 6 November 2026 |
DANKO Holdings II, LP / FISHLIPS, LLC | Lycoming County Court of Common Pleas | Two Muncy Township residents filed a land use appeal in Lycoming County Court of Common Pleas against the township supervisors and the developer, challenging the deemed approval of a data center conditional use application and related curative zoning amendment. They argue the township failed to hold a hearing or act within the 60-day period required by state code, and that the developer-drafted amendment amounts to spot zoning. The developer filed its application in late April 2026, hours before supervisors passed a nine-month moratorium on high-intensity data centers, and is contesting the appeal. The appeal was filed 14 August 2026 by neighbors Rae-Ellah and Sean Tetreault. Danko Holdings II, LP and Fishlips, LLC (owned by The Liberty Group) filed a motion to quash on 28 August 2026, arguing the appeal targets the deemed-denied curative amendment rather than the deemed-approved conditional use. The township asked for a remand for a conditional use hearing. Judge William P. Carlucci scheduled argument for 6 November 2026. On Friday 25 September 2026 Green Amendments for the Generations, with residents including neighbors Sean and Rae-Ellah Tetreault, filed a separate appeal in Commonwealth Court arguing that the Municipalities Planning Code provision under which the conditional use application was published as deemed approved, after the township held no hearing within 60 days, is unconstitutional and violates environmental rights and due process. The application covers three data center buildings (two 14-pod and one eight-pod), water storage and treatment and a substation near Yetter Road and John Brady Drive. |

East Whiteland Township data center moratorium moratorium Moratorium March 2026; permanent ordinance adopted 24 September 2026 |
n.a. | East Whiteland Township | East Whiteland Township, Pennsylvania, enacted a local data center moratorium or ban, recorded in SAVRN's moratorium tracker as dated March 2026. 180-day moratorium, board declared parts of data center zoning 'substantively invalid' and launched curative amendment. Developer Green Fig withdrew 1.7M sq ft application in May after sustained public opposition. The measure has a stated duration whose end date is not recorded. On Thursday 24 September 2026 the Board of Supervisors voted unanimously to approve a 32-page data center ordinance, after holding a moratorium for months while it re-examined zoning. The ordinance sets separation from homes, schools, daycares, parks and churches and addresses noise, water, cooling and power; it does not affect the 1.5 million sq ft project under construction at the former Cyprus Foote Mineral site. |

The judge vacated the injunction the next day. On 13 August 2026 the Board of Supervisors denied two extension requests and several preliminary land development plans, citing missing architectural, traffic and engineering information. O'Neill said he will appeal. On Wednesday 16 September 2026 O'Neill filed suits in the Montgomery County Court of Common Pleas challenging the board's rejection of the roughly 4.6 million sq ft campus, arguing township officials had said data centers qualify as warehouses permitted under the zoning code. In the Montgomery County Court of Common Pleas, O'Neill, represented by attorney Marc Kaplin, is asking the court to grant preliminary approval and appoint an independent referee to oversee further review. |

The district cites the campus's proximity to its schools on Columbus Drive and asks the court to rule that the developers have no vested rights under the legacy zoning. The Times-Tribune reported the suit could halt development of the seven data centers. |

4-3 Glennbrook Group | Luzerne County Court of Common Pleas and Salem Township Planning Commission | Luzerne County Judge Lesa S. Gelb ruled that the Salem Township Planning Commission violated the Sunshine Act at a July 2026 meeting on a data center zoning overlay for the Salem 3 project, after eight residents sued without a lawyer, and ordered a new meeting. The commission voted 4-0-1 on 27 August 2026 to again recommend the overlay, but that vote was later also found invalid under the judge's written order, and the commission planned a third vote. Township supervisors are expected to take up the overlay in October 2026. On Thursday 24 September 2026 the Planning Commission approved the overlay expansion for the third time, 4-0 with Susan Lynn abstaining as a landowner in the project area. The expansion covers more than 4,000 acres for 4-3 Glennbrook Group's Salem 3 project, which the Times Leader describes as a $1.4 billion data center project. The developer agreed to larger setbacks and a 65-foot maximum height. The Board of Supervisors is scheduled to take it up in October 2026. |

TECfusions Keystone Connect Building J land development appeal litigation Plan approved 5 August 2026; appeal filed 25 August 2026; moratorium ends 2 November 2026 |
TECfusions | Westmoreland County Court of Common Pleas | Protect PT and two New Kensington residents filed a land use appeal in Westmoreland County Court of Common Pleas challenging the Upper Burrell Township supervisors' 5 August 2026 approval of a land development plan for TECfusions' Building J. The plaintiffs argue the developer should first have been required to obtain a special exception from the zoning hearing board. The township's 180-day moratorium on new data center development, adopted in May 2026, did not cover permits already granted for Building J and ends on 2 November 2026. TribLIVE reported the appeal was filed on 25 August 2026 in Westmoreland County Court by Protect PT and Upper Burrell residents Allen Uhler and Guy Fuller, arguing a data center is not an authorized use and TECfusions should have gone to the zoning hearing board. |

Every state, one page each
Figures beside each state are named sites and blocked, delayed or restricted projects.
Seven references, one system
Capital, delay, policy, water, grid, permits and scarcity are one system seen from seven sides. Each reference is primary-sourced, refreshed on a schedule, and links into the others, so a project can be followed from the money committed to the docket that stopped it.
